    • Hello, welcome to CAG. It would be a good idea for you to read other shoplifting threads here to get an idea of how this works. The police won't get involved now, so no chance of arrest. You need to avoid that branch of John Lewis for a while though. Basically, John Lewis's security people will give your details to either a firm like Retail Loss prevention or DWF solicitors who will then write to you with scary-sounding letters to frighten you into paying them some kind of penalty. They have no legal power and can't take you to court, only John Lewis can. Last time we saw a retailer in court against shoplifters, it went very badly for them and we haven't seen a case like that since - over 10 years ago. But you need to figure out why you did this. If you need support, talk to your GP and aske them. They will have heard it all before and won't judge you. Best, HB  
    • In addition to the information you've been given above, I suggest that you spend some time reading up on the stories on this sub- forum. There is a lot of information about suing as an entitled third-party. Take a couple of days – and by Monday you will be much more confident. More in control and you will have fewer questions to ask but the questions that you do think up will probably be more relevant and more interesting to your case. Do the reading. This is always an essential first step   Additionally please can you give us more details. What was the item, was it correctly declared, was the value correctly declared, what was the value that was declared? Very importantly what date did you send it?
    • I got caught today shoplifting some shampoo & conditioner at John Lewis. I felt absolutely awful. The people were quite nice as I returned the items without any hesitation, gave them my name, address & DOB. They did not ask for official ID, and let me go after taking my picture and then handing me a paper saying I am banned for life. I just now read on the paper that they may share my details with third parties (police) and am extremely stressed. I've previously shoplifted, not at this John Lewis but others of their stores (an absolutely horrible habit made worse by cost of living crisis).... How likely is it that they will actually start an investigation for this offense? May I get arrested for this? While I was in the backroom, the security was quite nice and told me that no police would be involved unless I broke my ban.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A friend of mine who has been going through the same process as me has finally recieved a cheque from Cobbetts for the amount of £2143.00. (that means I should get mine by the end of the week!)

 

The only problem is that it is made payable to him, and it states it has to be paid directly into his Natwest account (account number on the cheque). He has a £3000 overdraft which is is dspute and paying the cheque in to this account would just swallow all of the money.

 

Is there anyway that this cheque can be paid into an alternative account?

15th June 2006 - Requested Statements from NatWest

30th June 2006 - Received Statements

15th July 2006 - Preliminary approach sent for £2,156 in charges & £351.78 in interest on those charges

22nd July 2006 - Received standard response from Stuart Higley - Saying get lost

29th July 2006 - Letter Before action sent

8th Aug 2006 - Standard response saying Get lost

7th Sep 2006 - N1 Form Submitted

25th Sep 2006 - Claim Acknowledged by Cobbetts

11th Oct 2006 - Defence Entered by Cobbetts

If the o/d is in dispute because of the charges, then repaying the charges will make it not in dispute anymore, with the remaining amount (if any) being made up of what you actually owe (borrowed) to the bank, right?

 

I know I'm not going to make any friends here by saying that, but in my opinion, the bank is perfectly within its right to set off the penalty charges repaid agaisnt the amount "owed" and your friend should see it as gettign one step closer to financial recovery. Why should anyone want to KEEP a 3k o/d hanging at their neck?

 

My advice is pay the cheque in, and immediately get NWB to drop his o/d limit to 1k so he can't go spend spend spend again. He will then be saving a fair bit of interest every month, and have one less major debt to worry about. What's wrong with that? And he won't be so much in fear that one day, NWB will pull the plug on him, leaving him in worse dire straits than ever.

I agree, the charges have been returned that is a good outcome.

My advice has hardly any legal foundation whatsoever, however you never know it it might just work!

I too had a cheques with a specific account no sent ot me but it was not for the full amount. I have an od with nw, but I beleive it should my choice which debt I pay off first and I have a CC with them that I wish to reduce first. I also have another claim in with them. Isent the cheque back and asked them to resend without that specific account no on it and gave them the no of the account I would like it paid into. Then I will split the amount according to interest rates and how it suits my finances best. If I paid that into the account they suggested then they would reduce od limit and I would still be left with the high interest CC - which they have closed.

This issue has arisen before. There is no harm in trying, however there is a debt to the bank and they have a debt to you. Sadly your debt to them exceeds theirs.

 

But the debt is an authorised overdraft - and I haven't agreed to pay it in one lump sum - and the charges were rolled into a loan 4 years ago which I am still paying monthly - so none of my overdraft is made up of charges.
