    • Dx100uk according to the ICO office, who I spoke to at some length earlier today after getting the email from the court, Equita are the data controller if they have instructed the contracted EA. The ICO have noted the case, and stated very clearly that the court has the higher standing in terms of dealing with, and punishing either party if they fail to adhere to the district judges order and any action they take will not be criminal.    but they also stated very clearly that with what I’ve told them, and on the basis of accepting what I’ve told them as gospel (which it is with written confirmation from both the courts and the police) then there is some major red flags being raised on both sides with them blaming each other.    they’ve advised me to essentially keep my powder dry until there is a charging decision and an outcome from the seperate proceedings with the EAC2 complaint, and then come back to them with the case and they will be in a stronger position to act against Equita and the EA as there will be established facts and evidence that have already been laid before a court.     
    • urm.. i seem to recall another assault case whereby the approved bailiff company claimed the body camera was nor theirs but a pers one of the bailiff, i think they got in serious trouble for it. i believe that breaks certain gov't approval for a bailiff company/firm regulations/laws  if memory serves me right?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

Today I have checked my credit file

 

 

to find out that MMF have placed a new default on my account ( it wasn't there last month ).

 

 

I've copied from noddle the information below.

 

Account start date 03/09/2008

Opening balance £ 579

Repayment frequency Monthly

Date of default 25/09/2008

Default balance £ 579

 

 

Do I request proof of debt from MMF ?

I don't understand why this has suddenly appeared when the default date is nearly 6 yrs ago !

First, place a notice of correction with the DCA. Also check the other 2 credit reference agencies. They should enquire to see if the entry is legit. If it is, then you can challenge MMF. You also need to check the historical entries and see if it has been listed on your file at any time. However, even if it was, in the next 4 weeks, it will be removed from your file.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If that default date is correct then this becomes statute barred 25 Sept this year hold off sending anything to MMF at the moment.

 

 

Do Nothing until MMF actually contacts you, don't be tempted to pone or speak to them.

Don't alert the CRAs yet either> MMF no doubt hope you will make contact, admit the debt and offer payment.

 

 

I suspect this one of the very old PDLs.

 

 

Do you know which PDLC this may be if any payment or written acknowledgment has been made since the default date.

02/09/2014

NOTICE OF TRANSFER OY YOUR ACCOUNT

CREDIT AGREEMENT DATED

ACCOUNT NUMBER........

CURRENT BALANCE £578.92

 

Please accept this letter as our notice to you that we have today assigned all of our rights and interest under the above loan agreement and your outstanding debt with Northway Financial Corporation Limited to Motormile Finance Uk Limited of Protection House, 83 Bradford Road, Leeds LS28 6AT.

The assignment does not affect the terms of your loan agreement or alter your rights. You should now make all future payments under the loan agreement to Motormile Finance Uk Ltd. They will shortly be contacting you with regards to making payment arrangements to pay what you owe under the agreement.

Yours faithfully

 

This came in the same envelope as a letter from Motormile telling me that they now own the debt.

 

Surely MMF should of sent this letter before they placed a default on my account.

Does this change anything or is it still statute barred on the 25 th September

No the procedure is correct, you have been notified of sale an purchase of the debt and the CRA files have been updated.

 

 

Is the default date the same as the original creditors entry?

Nothing changes.

Hi

There was no original creditors entry. The first I knew of this was when MMF put the default on my file in June. Sorry if I sound daft but how can they default onto the file nearly 3 months before they notify me they have bought the debt ?

These debts are bought and sold in portfolio lots, so it takes time for the various processes to be put in place.

 

 

It seems that many of the lenders that MMF acquire debts from default accounts immediately prior to the sale thus never entering the default on the account in their name.

 

 

Do you know when the last payment or written acknowledgment was made in regard to this debt?

No idea. I wouldn't of received any written consent ad I moved out of the property in November 08. So I know I would not have paid anything after this date. Sorry I can't be more specific.

As the debt has been sold the original creditor can be asked for the date the account was defaulted.

 

 

Either by a quick phone call or more formally by making a SAR.

No need to SAR, the debt will be statute barred in a few days and drop off the account anyway, unless of course MMF 'find' an alleged payment.

 

SARing would be a waste of time and money.

 

I would wait until they contact further and write back stating statute barred and no further contact allowed.

 

Then you complain to the authorities about this late registration of a default.
