    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I Need advice - please:

 

I received new contract to sign but I DIDN'T SIGN YET

 

POINTS ARE:

- My working hours are changed from 9.30 – 5.30 to 8AM – 6PM

- My lunch break has been changed from 1 hr to 0.50 hr

- My bonus and Salary are changed, basically smaller bonus and bigger (small change from 30.000 to 32.500) salary but finally I am going to be paid £400.00 less / month

- New role/ title

- New / more responsibilities ( my current responsibilities plus more)

- New unreasonable targets

 

I don’t want to signed this, I am working in accounts department over 7 years and my question is: Can my company refuse my redundancy ? ??

 

Looks like my current position doesn't exist anymore, I have new one where I will have my current duties plus more.

 

 

I was told today that I have to replay with attached signed contract or refuse to sign with detail why until tomorrow.

I have to refuse to sign because I can’t work 10 hrs, plus overtime to do my targets, but I don’t know how to replay, I don’t want to write something what after can be used against me? I’d like to be redundant in this case, not go without anything.

 

I have to add that there is no point to talk to my Boss, it wont be any changes

but I am polish, on many situations my English cannot be enough good , but I don't have a choice - I need to find something because I cant work long hours, overtime and do what before two people did

You do not have to accept the new contract and if redundancy is the reason for the changes then effectively you are being made redundant. Question is, how many people are being asked to accept changes or redundancy? What other criteria are being used if not voluntary. I would be asking sooner than later as you might get a better deal if you make the arrangem,ents rather than leaving it to company to make the decision

Everyone has now different job description and different roles, new unreasonable targets, and cuts.

The problem is that we don’t have credit control which is very important role in this time, we had a few years ago 2 people working as a credit control, after one and now again one but without experience and working as a contractor so they want us to help him and do credit control as well, because IS CHEAPER.

 

We don’t have time to do this, one person left in 2010 and his job has been split between us, I took around 50% of his responsibilities, now they trying to do the same again.

 

My job description has different tasks now, 95% are credit control and only 5% what I am doing now. Looks like someone doesn’t have clue what we are doing here and how.

Redundancy would require the job to disappear for financail technical or operational reasons. It could be argued that the operational reasoning would mean that by not agreeing to a new job you are in a position of redundancy and they should thensever your employment contract on that basis.

On a more practical note if they dont suggest redundancy they are unfairly dismissing you as the job is still there and there are no technical reasons (new technology etc) to do away with the role. they should continue to employ you on your old contract and pay you accordingly but beware of sudden changes to the bonus scheme.
