Do you want to see bailiffs properly regulated? Then write to your MP asking him or her to support Early Day Motion 2868.

An Early Day Motion is one way that MPs can tell the Government what is important to them. EDM 2868, which was started by a Labour MP and then immediately supported by a Tory, calls on the Government to put effective proposals to regulate bailiffs into the draft Tribunals, Courts & Enforcement Bill.

At the moment, the draft Bill contains proposals for a new bailiffs certificate but they will do nothing to deter rouge bailiffs from acting unauthorised and make it much harder to identify and punish an uncertificated bailiff. Even if an uncertificated bailiff is prosecuted, the proposed maximum fine of £200 will be far less than the cost of getting a certificate! (Can you imagine the Government setting the maximum fine for not having a tv licence at less than the cost of the licence?)

The proposals in the draft Bill exempt bailiffs who are civil servants and some private bailiffs from the need to have one of the new certificates. This will make it very difficult, if not impossible, to identify rouge bailiffs. (Can you imagine the Government making it hard to identify a genuine policeman or anyone else who has the sorts of power bailiff have?)

Almost every complaint about a bailiff is actually a complaint about a contractor working for central or local government, collecting its money under government regulations.

If the Government wants to keep increasing its own use of bailiffs to enforce payment of its taxes, criminal fines and all the new civil penalties it is creating, it has a duty to its citiizens to properly regulate them to ensure the job is done properly and justly.

If you agree, write to your MP. You can find out who he or she is at UK Parliament - Directories - MPs and Lords.

Its the same story over and over. When this sort of thing starts. Nobody knows about it. The government does not make any sort of annoucement or make it public knowledge. It is only once this has been passed that people find out that the government has put one over them and by then it is to late. I sent mine off yesterday.
