      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I requested that they called me to say they had received it on the fax I sent, which they kindly did. Julie said they will be processing the claim shortly. I have till the 30th. Maybe if I dont hear anything from them towards the end of next week then I think I will ring them again to see where the claim stands

I have returned home today from work to find that I still have no post. My deadline is the 30th. I really don't want to have to fill out the AQ. I am thinking of ringing AG Sol tomorrow and what the status is of my offer....

 

You guys think thats a good idea?

by all means - ring them.

i think we are seeing an emerging pattern - last weekend fri, sat there were several 100% offers and most of them had aq's due this week - therefore (i've been wrong before - so don't hold me to this - if your stuff is in the pile- i'm thinking a lot more offers end of this week for the aq's due next week - that would mean you)

now, read slouhart's thread - he was one - and he got his earlier than most and thinks it's because he faxed his breakdown to dg every day until they made an offer. i'm not saying that's the way to go - but

he who shouts loudest, gets heard - yes,ring again tomorrow.

the aq isn't that bad to fill out look at that bex link i gave you up above. i'd have it ready just in case.

My AQ is due on 30th as well.

 

From what lateralus has said it would appear they are on the way.

 

I will keep checking my post and your thread. Fingers crossed.

I wish you were right lateralus!!! Didnt have anything in the post this morning. I am going to have to fill out my AQ and send it off in Tuesdays post. Has anyone else received an offer recently with their AQ deadline so close? What happens when I return my AQ?

I have had to post my AQ off this morning. I really thought I would get an offer today, but a am susceptable to disappointment. I am worried that this will go further. Hopefully my AQ and their offer will cross over in the post. I dont know how Flunky got on??????

i'd say send an e-mail to: juliekyle@hsbc.com

if it follows the patterns - that will be hers - and say: dear julie, after our phone conversation of xx/xx/07, i was hoping to have heard back from you by now. as my allocation questionaire was due, i have filed it. please note on my file that my claim will now cost another £100 to settle.

(that's if it did). then,.... please contact me if you require further information on my claim. and give a phone/fax/mobile number. just showing you are keen.

fax the same info. to the attention of julie kyle.

keep at them.

Me and you are in the same boat.

 

I sent off my AQ to court. Asked solicitor friend of family to deliver to court when he took his cases today. He has looked at draft direction said looked ok just whether they attend or react or not is up to them. So seems ok. Not heard a word from Julie Kyle will call today and inform them that AQ is in.

 

She never said 2-3 weeks to me as I have seen on other threads I was expecting offer in post at least by today after conversations I have had previously.

 

Not getting nervouse I would love my day in court. When I started all this I did not have clue (see start) now I am just getting more and more angry. The amount of people I see in here some who really have had the p*ss took out of them astounds me.

 

It bugs me, if they are gonna pay then they should do it if asked. To take people through all this is WRONG.:-x

 

Keep at them and best of luck. I will keep an out for your thread.

Right, after many a failed attempt I finally got through to Rachel Tompkinson this morning. She took my claim number and said that she is finding it difficult getting hold of their client (HSBC), but we would hear from them soon. Hopefully this has put me on top of the pile to be sorted. Fingers crossed. I mentioned that I had fild my AQ and she said that was fine. Quite nice really!!!

Had nothing in the post over the weekend so I took it upon myself to call Rachel again. I got through this morning and aksed if I would be hearing anything soon. She said that HSBC are being 'awkward' to get hold of, but I will hear something as soon as DG do. Just wish a nice letter would come through the post with an offer!!! my AQ was filed almost a week ago.

raxty, have you seen this letter - it called an unless letter. if you've filed your aq and you ring the court and dg has not filed theirs - after a week - send the court this letter asking the court to give dg one week to file or their defense will be struck out and you hopefully then can file for judgment.

here's the basic wording:

 

The last date for filing the Allocation Questionnaires was the x, the Claimant filed this document on the x, however it is understood that the Defendant has yet to file the same.

 

Accordingly, it is requested that the court issues directions to the effect that the Defence is struck out without further order and judgement entered for the Claimant, unless the Defendant issues the Allocation Questionnaire within 7 days.'

Its ok Lateralus, there's no need. As yesterday was the climax to all this. I received a lovely OFFER!!!! in the post yesterday. Oh joyous occasions!!!! Its was for full claim amount....£1079.80. They hadn't allowed for the 0.20p a day since the claim was made, but that only totals up to about £12.00 which I'm not all that fussed about.

 

I don't know if anyone else who gets there offer get a comical letter from DG saying that HSBC are positive that if this went to court then they'd be sure of winning (words to that effect), however we will give your money back. Joke or what!

 

As I've read on other threads, I guess what I do now is ring up the court and ask them to freeze the situation on the claim and tell them that I have been made an offer and I'll contact them again once the funds are in my account.

 

To all those who are reading this thread and thinking 'Oh, but it'll be different for me. I bet I'm the one which will be taken to court' Trust me, I felt the same, you WILL GET YOUR MONEY BACK if you put a little bit of time and thought into what you want back. The guys on here have been more than helpful, it's so refreshing to talk to people who actually want to help you, and they are a mind of information aswell!!!

didn't have time when i read this to comment appropriately - but finally, well done and congratulations - it was a long time coming - but you got there.

 

here's a little letter going around to use if you likeI wrote this to the court today

 

 

Claim No.*********

I wish to inform the court that the defendants in the above claim have written to me offering an ex gratia payment in full and final settlement of this claim. In principal have decided to accept their offer and I am currently in negotiation with them as to the terms and conditions they have attached to the offer.

Should the claim be resolved to the satisfaction of both parties I shall inform the court immediately and withdraw my claim.:
