This discussion is by no means finished......but you must all be aware that as it has been made clear that info is being extracted and digested by the other side

then you should make up your own mind as to whether you want to openly discuss your course of action.and respect others who may not wish to.

 

I should say that there is no need for panic nor assumptions about the forthcoming cases and there is no proof at this stage that all other litigation will be concluded the same way we should remain calm composed and concerted.

 

At the end of the day it remains that these charges were unlawful and todays verdict ruled nothing short of that we should remember there is still a long way to go here and no prececents have been set........we should carry on regardless and see what unfolds.

This has been an unexpected development but by no means a justification.

I agree with Martin. It appears that Citi got away with a 'smash and grab' today, but it also looks like they only managed it by a combination of luck and circumstance. I think it's unlikely that they will always encounter such an accomodating judge. Of course, we now have a pretty good idea of their strategy.

Robertxc v. Abbey - £3300 Settled in full

Robertxc v. Clydesdale - £750 Settled in full

Nationwide v. Robertxc - £2000 overdraft wiped out, Default removed by order of the sheriff

Robertxc v. Style Card - Default removed by order of the sheriff

Robertxc v. Abbey (1) - Data Protection Act action. £750 compensation

Robertxc v. Abbey (2) - Data Protection Act action. £2000 compensation, default removed

Just a further thought ~ more of a question. Exchanging documents. Each side prior to going to court has to prepare or list of documents relevant to the case.These lists then have to be exchanged with the other party. Exchanging documents in this way lets each party know the precise basis of each others case.

 

Now I appreciate this excludes privileged documents ~ though surely you should have been informed that they were going to detail how their costs arose, even if they were not prepared to divulge the detail to you.

 

That would have given you the required notice to consider the implications and your response!

I have just received a s*d off letter and I think they are referring to this case. this is what they wrote:

 

Citi was involved in a recent court case in Northern ireland, the case of ******* V Citifinancial Europe PLC, in which the fairness of these charges was challenged. The court dismissed the case, implicity finding that the charges are fair and in conformity with OFT guidance and common law principles of contractual damages.

 

Have they just blatently lied o me? I want to reply and tell them they have lied and i will show this letter to the judge when they appear in court. What shall i write as a response. I am happy to go all the way to court even if it is for my £8.00 difference so they can think again if they think they are going to get me to back down now.

 

I REPEAT: THINK AGAIN IF YOU ARE READING CITI CARDS

I dont want to say too much at this stage except to say that they are misinformed if they are of the view that they will halt any further actions to recover charges.This only adds to our determination.:)

we don't intend to be mean,but we all know who is reading this and we want them to remain completely in the dark as to what may be waiting for them.....they have used information gleaned from here before,and they won't be doing it again!! :D
