      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello, I have just started my claim with the Ulster Bank as well. They were sent their request for charges letter on 16 April. Still waiting on acknowledgement that they have even recieved it. I will let you know how I get on.

I have three accounts with Ulster Bank to which they owe me a total of £13,945.00 in unfair charges. I am about to send them my first letter and I am going to fight them the whole way. My intention also is to settle for nothing less than a multiple of the initial amount (between 4 -6 times) if they decide they are going to push me the whole way.

 

1. Has anyone charged them a multiple of the amount of claim to settle when the bank pushed it the whole way?

 

2. I also have 2 accounts in Ulster Bank, Monaghan, Southern Ireland and again there are massive charges that I want to reclaim. Has anyone any knowledge of the banks in Southern Ireland having to repay their fees.

i think you should start by reading the step by step guides vw. you should try to understand the process before you send your first letter. i think you might be getting carried away......

I am only asking the question rather than making a statement. I have read where someone did received a settlement for 5 x their origional claim at the point of settlement. The bank in this case had pushed it to the court date before asking for settlement and I see my case going the same way?

Hi, I am claiming over £6000 of charges over the last 6 years from the Ulster Bank. So far I have sent 2 letters and had the reply that their charges are fair etc ........So today I downloaded and sent off the Financial ombudsman complaint form, after some research I learned that the ulster bank has paid most of the charges back after the complaint being investigated by the FOS. If I don't have any luck there I will make a claim at court. Will keep you informed :confused:

I am about to start with my first letter being sent to the Ulster Bank. The total fees to be reclaimed from them including interest for 3 x accounts is £14,500.

 

I am new to this so in general is it better to go the Financial Ombudsman route with them or threaten to take them to court.

 

I would like to know which carries the most weight?

General concenus from what i've read and seen is that both can be effective but i believe the financial ombudsman can be time consuming given the amount of cases ongoing. my personal plan for my mum and ulster bank is to take the small claims option as per so many successes so far. Only problem my mum has is that she has an overdraft thats got her on the backfoot, if they confirm that its extended then i can plough on! Small claims may cost you initially but it will be refunded, and they'll pay you interest...... Be sure to seek advice on claiming back such a large amount as NI small claims limit is 2k, and there seems to be differing opinions over whether or not to split claims etc, and it appears you'll need legal representation to go to county court for a sum over 2k in one hit.

I have now come to the conclusion that it is best that I take a civil case against the Ulster Bank as it is faster than Financial Ombudsman and you get the interest paid to you whereas with the FOS you do not get the interest paid?

 

Another question I have is this: -

 

I have been charged quiet a lot of service fees in the past for things such as the number of cheques lodged etc.

 

Is this type of fee reclaimable.
