    • Hi all.   I've just cancelled my Virgin Media because my Wife and I are going abroad for 12 months or so. My Son will be staying in our home, and wishes to start a contract with them. He signed up to a great deal for New Customers online, and a Contract Agreement was signed online. He had a delivery date for a Self Installation Kit but it never arrived. After speaking to numerous Virgin Media Staff online, they are insisting that he calls their Pre Installation Team (I presume that is their sales Team to try and get more money). He doesn't want to speak to them over the phone. He doesn't mind doing a Live Chat, but he hasn't got an Account Number yet, so that's impossible. He even had a chat with a Team Member on Whatsapp, who say they don't have access to the information they need, so he has no option to call them. Why can't they just be straightforward with their Communications. Is there any other option other than calling them?   TIA.
    • Hi All, I'm looking for help with a P2G claim for another lost parcel. Given the wealth of information on this site, I'm hopeful that this should be an easy one to fix, but want to be sure I have everything. On the 6th March, I contracted with P2G to send a parcel (a £600 Pioneer AVH-Z7200DAB car stereo which is not on either P2G or EVRi's excluded from compensation or prohibited items list) using EVRi, sent it off, and that was the last I heard of it. The EVRi tracking showed that the parcel had made it to the national sorting hub at 2:12 on the 7th, and then vanished. By Friday, I had started to get nervous, and so, raised an enquiry. And then another, and another - well, they weren't responding, and I couldn't get their telephone one to work, I think in all, it was more than 15 enquiries. I also raised an investigation with P2G as well. EVRi closed the enquiry confirming a loss on the 19th March, and P2G near the end, although P2G closed it claiming that I needed to send photos of the parcel as proof - which I didn't have, and I also do not have an account with P2G so couldn't upload anything (I did test, just in case), and this is why despite receiving advice on the EVRi Fb group to send the letter before claim, I haven't yet acted. I have proof of the eBay listing, and the refund, to demonstrate that which was being sent, but P2G's insistence that I have no photographic proof of the parcel with the label - I have the photo of the goods in their box before sending, but this is for the eBay listing, and so does not show it after the fact. This I fear is what P2G will seek to rely on as a defence, hence my 10 week delay on progressing with this. But, I am more than £600 out of pocket for the loss: £600 for the item and £8.04 for the delivery fee, although my claim will actually be for an initial £611.09 to cover the cost of the loss, their delivery fee, and my 1st Class Recorded stamp for the Letter Before Claim to P2G, rising to £681.09 to cover the additional £70 cost of opening the court case if they fail to respond within 14 days. This question mark surrounding P2G's request for photographic evidence, is this likely to cause me a problem? Steve
    • Had a letter response today dated 12/6/24 from PRA Group re request for information consumer credit act 1974. Confirming they are in receipt of my CCA letter request - and that they are requesting the required information. They returned the £1 postal order. And my CCA letter. Stating that they will contact me with an update ASAP. They attached/included a standard ( non personal ) page about ' what they should provide ' and ' what happens If I don't get this information'.    I need to file my defence by 21 June 24. Any suggestions as to what that defence should be ?   
    • Thanks @dx100uk for responding promptly.    To be quite honest with you, applying for breathing space might not really help except some short term relief. I don’t want to default either as I might lose my job too and I cannot really afford it. Sorry for sounding bit stupid but is there something I can do to stop them charging interest and agree on reduced payments? Can I use pro-rata payment letters to get out of this situation without too much impact? I am working on information that @BankFodderhas requested and will be sharing it later today.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I am new to the site and wondered if there is a template for the initial letter you send to the bank asking what charges you have incurred over the last six years. Also the address you mail it to.

I looked in the FAQ as directed but there isn't a copy of a letter to send to ascertain my charges for the past six years. No problems I will devise one myself.

yes there is it is a DPA request....

Status:

 

Halifax - DPA sent 03/03/06.

Prelim Letter - Sent 27/03/06 ignored.

LBA sent 10/04/06 - Ignored

Moneyclaim filed - 26.04.06

Acknowledgement received 3rd May. Halifax state they intend to defend.

Halifax Settled in Full - 17 May 2006

Just wanted to know what charges I can try to claim back, I know Unpaid DD charges and excessive Overdraft charges can be but can overdraft interest charges be claimed also or not??

 

Sorry if this is in the Library but I trawled through it and couldn't see it anywhere.

 

Also when sending my letter off do I need to highlight the charges for both accounts I am claiming for seperately or do I lump them together??

This has been discussed many times. Search on "interest" and "overdraft".

 

It doesn't matter of you pool the accuonts of it is less than £5000. This has been dealt with many times as well.

You could always get rid of that big ego of yours and try helping people alittle more rather than being so condescending all the time.

 

We are all in the same boat, just looking for some friendly advice as to how and what we can claim back from our banks.

Rude and iliterate, that's a good combination. I think you meant to write Bankchargeshell not cahrges.

Hi,

 

Can I claim overdraft interest as well as excessive overdraft charges??

 

I am getting confused, can I only claim the overdraft interest when I have paid an excessive fee or can I claim any overdraft interest. This reason I ask is when I was £900 overdrawn I was paying anything between £20 - £30 overdraft interest but wasn't always incurring and excessive overdraft charge.

 

This makes quite a difference to the amount I will be claiming. I have looked in the FAQ's and the library but cannot see this anywhere.

 

The template letter requesting charges to be repaid states :

 

What I require

I calculate that you have taken £ plus £ which you have charged me in overdraft interest for the sum which you have taken. Total £

 

Is this referring to the 8% you can claim back of them or is this any overdraft interest you have paid ever.

 

Any help would be appreciated.

Yes, I agree. This is a little confusing.

 

As I understand it, I would assume you can only claim for the interest on the amount of the specific (unfair) charge for the time you remain over your overdraft limit. I don't think you would be able to make a justified claim for the usual monthly interest they would charge on the agreed overdraft if you used the facility. (i.e using your overdraft, but not going over your limit)

 

I don't think I have the mental capacity or will to work out the proportions of interest on specific charges while I was overdrawn and paying interest on my overdraft. I would need to know the interest rate I was paying on my agreed overdraft at the time (going back 6 years), I would then need to know how much over my overdraft any penalty charges took me - and for how long - to work out the proportion of interest A& L were charging me, on the penalty charge incurred. I think... It's hurting my brain now.. :(

 

 

I would also welcome some clarity on this, as I am about to issue A&L with the Letter Before Action as I have now received the (700 pages of) information I requested in order to determine how just how much they have fleeced from me. (£548.00) I was just going to take out the last sentence about interest. If it goes to court they will have to pay another 8% anyway which take the total claim up to £742.00. Happy daze....

It makes a difference with my claim unfortunately for the worst if your correct re the overdraft interest, which if I am honest I was thinking would be the case. But you can hope can't you.

 

I will send my claim through for the amount charged then excluding the O/D interest. Is your £448 made up purely of excessive charges and no O/D interest at all, if so what do you put for the bit in the letter that says "I calculate that you have taken £ plus £ which ....

 

Still confused, I have £550 in charges so do I just put the £550 in excessive overdraft charges and that's it. What amount needs to go in the first bit that says "I calculate that you have taken £", surely if there is no interest added in either then the amount is just £550. Am I right or am I just confusing the matter unnecessarily.

I am about to send my initial letter to Lloyds asking them for my money back, I got the template from the Bank Template Library. It says they have 14 days to come back to me if not I will send another letter giving them 14 more days in which to respond to me before I take action (or words to those effects).

 

I also noticed another letter in the same Library which just says you have 14 days notice otherwise I will start a claim against you for money plus interest, plus costs etc.

 

Which letter do I need to use as both of them have pretty much the same text up until the last paragraph.

 

Any direction would be appreciated.

The preliminary letter is first. The letter before action which says that you will begin your claim in 14 days is second.

It has nothing to do with the excessive overdraft charge. You simply want back what they have taken in relation to unlawful charges.

Each time they took £35 or whatever, if you were overdrawn they charged you interest on the £35 every month. It is that interest charge which you want back.

So if they took charges of £100 one month plus interest at 15%pa on that £100, that would mean that at the end of the year they would have charged you £15 and you want it back. If they only charged you the £100 charges 6 months ago then you would want the internet back on that which would be £7.50

 

Working out what they have charged you in interest each month and adding it all up is a pain but it adds up to a significant amount and rather in your pocket than in theirs and if you don't want it then you can buy us some law books with it.

I sent my initial letter today asking for my charges back, I also backed this up with an email to contact.us@lloydstsb.co.uk. I went to lunch and on my return I had already received a reply. Please see below, I also had a PDF attachment which explained there complaints procedure with address's and contact numbers etc. (tried to attach to this post but it won't let me).

I am sorry to learn that you appear unhappy over the level of charges you have incurred on your Lloyds TSB account.

 

Under the circumstances, your e-mail/letter has been passed on to the Manager of the Complaints Unit within Service Recovery. I have asked that he notes your comments and issues raised and arranges for a response be sent to you at the earliest opportunity. I have also noted that a copy of the letter has also been posted to us.

Received letter back today from Lloyds saying that I accepted the terms & conditions and they clearly state that they can charge for going over my overdraft limit. They also said if I can't run my account within the T&C's then they may consider withdrawing certain services like DD's, Cheque book etc (then suggested I may want to make alternative bank arrangements).

 

Anyway I guess its time to send the second letter giving them 14 more days to comply before I start court action against them. Can someone clarify if the letter entitled "letter before action - consumer version - asking for it back". Just getting a bit twitchy now and want to make sure I am following the process correctly.
