    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I hope you get your exchange BC, because sometimes when you're not happy in a place you're living it can have a negative knock on effect in other aspects of your life, and I truly believe that!

When you're happy in your home and area, it gives you a sense of calm in the mind - which once you have that it attracts positive energy into your life! I know it sounds like mumbo jumbo, but it actually does help.

This recent weather really describes the UK, only the UK could have blazing sun, humidity, a fast onset of winds and pouring rain all in the space of a few hours

Also, and I may have said this in a previous post - but Sunday roast dinners! I'm just about to put my roast potatoes in, chicken, with roast potatoes (done in goose fat, wrong I know but only on a sunday lol), carrots, green beans, roast onion, Yorkshire puds and home made gravy!

Can't wait! :-)

Life is like an echo, it all returns......The good, the bad, the false, the true......So if you give life the best you have, the best will come back to you.

The Shakespeare John O' Gaunt speech in full:

This royal throne of kings, this scepter’d isle,

This earth of majesty, this seat of Mars,

This other Eden, demi-paradise,

This fortress built by Nature for herself

Against infection and the hand of war,

This happy breed of men, this little world,

This precious stone set in the silver sea,

Which serves it in the office of a wall,

Or as a moat defensive to a house,

Against the envy of less happier lands,

This blessed plot, this earth, this realm, this England,

This nurse, this teeming womb of royal kings,

Fear’d by their breed and famous by their birth,

Renowned for their deeds as far from home,

For Christian service and true chivalry,

As is the sepulchre in stubborn Jewry,

Of the world’s ransom, blessed Mary’s Son,

This land of such dear souls, this dear dear land,

Dear for her reputation through the world,

Is now leased out, I die pronouncing it,

Like to a tenement or pelting farm:

England, bound in with the triumphant sea

Whose rocky shore beats back the envious siege

Of watery Neptune, is now bound in with shame,

With inky blots and rotten parchment bonds:

That England, that was wont to conquer others,

Hath made a shameful conquest of itself.

Ah, would the scandal vanish with my life,

How happy then were my ensuing death!

  • 3 months later...
Lot of people say that they are not a fan of the Beatles, but I will bet if they are honest they can hum at least three of their tunes, not bad for a band that broke up over forty years ago.

Rain

I'm one of those "lots of people" too.

Just do not get them at all.

Yes, I can probably enjoy far more than 3 songs, probably closer to 10 or even 15.

Best ever? No way.

I know at least 30 Lennon solo songs that are far superior to the Beatles.

A lot of people say the Beatles were the best simply because it's what they always hear.

Give me the Stones anytime!
