Hi. I am shortly to commence legal proceedings again both the Halifax and Nationwide. Both claims are in excess of £3,000 and I'm happy to put this through the English legal system just to get it over with, and also happy to travel to England if need be.

 

A quick question though regarding the location of the Court, could I, for example, lodge papers in Newcastle rather than near the HQ of both Financial Institions? I'm based in the Lothians and would find it much more convenient to travel to there (as it's on the main rail line!) than some of the other Court locations.

 

I've prepared the forms N1 for both claims in advance (I'm not expecting a positive response from the Banks to my demands!) but would be grateful for any advice that can be offered in this respect.

sure as long as you have an address in Newcastle you could use should be fine.

HBOS - LBA Sent 19/09/06

HBOS - Moneyclaim filed 06/10/06

HBOS - acknowledged claim 11/10/06

HBOS - partial offer received for £716 16/10/06

HBOS - I THINK I MIGHT HAVE WON!! HBOS credit my account

with £2341 + costs/interest!! will know details soon

yeah, you dont need an english address if you are filling out the n1 form manually afaik. (not through MCOL) But the case will probably be heard in a court local to the defendants. Perhaps possible to get it switched to an english court nearer you though. Not sure coz i havent went through this procedure so cant say for sure

I thought that was the case if I filled in the N1 manually. Weird that they won't just let me use MCOL and have to actually write. Oh gawd, do peope still use paper and pens?!

 

Halifax have until Tuesday to refund me, and Nationwide have until 31st October. Look like a busy month for me!

I have now sent N1 forms in respect of both my claims against the Halifax and the Nationwide.
