      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Even better - they waste their time and money doing a personal letter because they are so arrogant they can't resist telling you that they won't reply to your letter - even though they are replying to your letter.

 

Was the envelope written in crayon?

He damaged my car & wont provide insurance details

 

Some years ago I had reason to suspect that someone I was dealing with through my company was pretending to be a solicitor. I reported him to the Law Society and the Police.

 

Impersonating a Solicitor is a CRIMINAL offence.

 

He was successfully prosecuted, and very heavily fined. He also gained a criminal record out of it and nearly went to prison. He managed to plead that he was under massive stress and it was out of character, but he was very lucky...

 

He had done exactly what you suggest and produced some headed notepaper pretending to be a solicitor.

Checking the Law Society database for LCS Solicitors is fruitless - there is none registered. There is a firm called LDS Solicitors whose only solicitor is a David Barry Davies. He is the only D B Davies listed in the database. The firm is based in Epsom which is 14 miles from Reigate in the same county. Now call me a cynic but is this too much of a coincidence? Could this gentleman become the next BCarter?

No listing for LCS Legal on the Law Society web site.

This sounds like deception.

 

I suggest making a formal complaint at LCS: Legal Complaints Service home .

 

Just noticed : LCS Legal have the same initials as the Legal Complaints Service :confused:

Mr Davies has disappeared from the letterhead for LCS Solicitors to be replaced by R D Marr (Assistant at MTA Solicitors in Bromley) as "principal solicitor". Probably not a good career move for Mr Marr.

 

That is most interesting? I've just noticed you're reading the other thread that I just posted on. I wonder what it all means.

Perhaps Mr Davies saw the light and began worrying about an SRA investigation. The letterhead is pretty poor and looks like something run up on MS Word in a hurry. LCS also refer to Mr Marr as principal solicitor "at the time of writing". All silly really as LCS are unregulated by the SRA anyway.

although its interesting that this afternoon the SRA told me DB Davies was affiliated to LCS & LDS so they havn't updated their records yet.

Right I have 2 accounts with the Co-op; an old NR CC and a Smile loan. I CCA'd both account some time ago. The credit card is jsut an application with no prescribed terms but they sent t&c's for co-ops card and this was taken out with NR :). The loan has the prescribed terms but isn't that clear and refer to t&c's (which they sent for 2007 :))

 

I have been having letter battles with them for about 4 months and they have given their final response which basically says 'you have had the money and our agreements say CCA 1974 on the top so they must be right'.

 

My issue is that I am 4 years into my default sentance with 8 other accounts. Now in just less than 2 years time I will have none. The problem is that the 2 Co-op accounts are not included in the 8 so if they default me I have another 6 years to wait before my credit rating goes into the hundreds again!!

 

I note from my credit file they have changed from arrangement to pay to 6 for the last 4 months as I stopped paying both accounts when they sent through the rubbish they did (no statement of account either and the cc has loads of charges on it)

 

Now I know that they say the accounts are not in dispute and I say they are but I am guessing that in 2 months time they will default me and sell it off to a DCA.

 

What do I do???

I think your guess is probably accurate. I had a loan and card with the Co-op and they didn't have agreements and argued that since I'd perviously paid I owed the money. They then tried to pass it in to a DCA but the DCA passed it back to them when I told the DCA I had made a complaint to the FOS about the Co-ops unlawful activity on the accounts - I haven't heard a peep from them since. It's a pity about the credit reference files - I think it will be difficult to get them to remove any default they put on - the Information Commissioner doesn't seem to be much help with erroneus defaults.

Just an update for those of you interested in the internal workings at 1st Credit. D B Davies and LDS Solicitors seem to have disappeared from the SRA list of regulated firms.

LCS Solicitors still don't appear on the list as regulated.

1st Credit's new solicitor, R D Marr, has moved from the firm of MTA and now has a new listing as a solicitor employed by 1st Credit in their own right. All this has happened over the past few days.

There is an interesting point here - LCS Solicitors seem to operate under the 1st Credit Consumer Credit Licence although if regulated by the SRA they should work under the Law Society Group Licence (incidently expired but apparently still valid whilst renewal is being considered by the OFT). Wonder what is going on here? Is all our complaining about these two businesses beginning to bear fruit?

Its now 6 months since Co-op gave the 'we are right and you are wrong' letter to me. I have SAR'd them and they have made a note that they don't have t&c's from when the loan account was opened and that they have found t&c's from 2004 for the cc (although it was opened before that!). I did get another copy of my loan agreement but nothing for the cc. I am now getting texts and letters as I guess I am close to them defaulting me. Should I start paying on the loan account again?

If you feel you are on uncertain ground with the agreement and would feel better paying them then do (only what you can afford).

 

You can always then go after them for the charges!;)

Can anyone tell me what the APR should be on a £15k loan with £5038.61 charge for credit over 84 months?

 

I have tried a few online calculators and they all give different results!!

 

What are the limits that an an agreement's APR are allowed to be out by?
