      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

I wasn't sure if I should start a new thread, as I posted a few days ago Re: Aktiv Capital sending a £300 pay-us-half-and-we'll-sod-off letter with no details of the debt. I was advised to ignore and thats just what I have done. This is a completely seperate 'debt' by the looks of it, however if I should have added to the existing thread, then could a member of the site team please move it :)

 

I received the attached letter from Equidebt (Who?!) this morning.

 

It states the creditor as Aktiv Capital and that I owe £3926.53.

 

The only thing I've ever had in my life with that amount of credit was a credit card with HSBC that was paid off donkeys years ago so I really don't know where this is from.

 

Again, it's not on my Experian credit file and I haven't got a clue what the original debt was or who the OC is.

 

Now the kind hearted ladies and gentleman of Equidebt are offering a monumental discount - pay £785.31 over 12 months. A discount of £3,141.22 :| Going by past advice this usually means that they know their so called debt is unenforceable.

 

The thing that annoys me, is now they are giving me 20 days to contact them or they will recommend court action etc etc.

 

What would be the best thing to do to get these cretins off my back?

 

Has anybody heard of Equidebt and dealt with them before?

 

And as a quick side question, would anybody recommend Visa Vanquis credit cards to repair or build a credit score?

LETTER REFERENCES

 

I am in receipt of your letter DATED.

 

Whilst I appreciate that this could indeed be considered an extremely generous offer, as I owe you, nor anyone you claim to represent any money then I fail to see why you are making this offer ?

 

I would suggest you return this account to wherever it came from and ask them to provide you with the name and address of the person it is properly intended for. It would be quite a shame for them to miss out on this offer !

 

Further communication of this kind will be reported to the OFT and Financial Ombudsman.

 

 

 

Yours PRINT YOUR NAME ONLY.

 

 

Send it by at least recorded delivery so you know when it has been received by them.

 

Have you checked your own credit files to ensure there has been no reporting of this !

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This imo is clearly statute barred so send the following letter to Equidebt addressd to the compliance manager, by recorded delivery.

 

Ref: as on their letter.

 

Sir/Madam,

 

I refer to your letter dated xx xx xxxx in which you make a wonderfully generoud off for me to pay off an allged debt of £xxxxx.xx, please note I do not acknowledge any debt to Equidebt or its' client Arrow Global.

 

I am also grateful for Equidebt prompting me to check my credit history, this has caused me to conclude that any such alleged debt is STATUTE BARRED, therfore |I will not now or in the future make an payment or offer of payment in relation to this matter.

 

Should Equidebt or its' client dispute the status of the alleged debt you are reminded that the onus of providing uenequivocal proof of the status of the alleged debt falls entirely on Equidebt and/or its' client.

 

I am fully aware of the OFT Guidance on Debt Collection and the section regarding the pursuit of statute barred debt.

 

You will now cease to process all data realting to me and remove it from your records, close the file on this matter and return it to your client with the information given here.

 

This is my final response.

CitizenB - brilliant I'll send it today. Yes I have alerts for changes on my Experian credit file as I am now trying to build up a healthier credit score after years of neglect! I've paid back thousands in debt I did owe (wish I had found this place earlier!) so I'm acutely aware of any changes.

 

dx, thanks for that. I don't know how these DCAs are allowed to chase SB debt, it should just be made illegal as the targets are invariably below the poverty line and vulnerable.

Once they have been advised in writing that a debt is statute barred, both the OFT and their own regulatory authority the CSA say they should cease chasing.

 

If the debt is statute barred then they will not be able to take court action to recover because the statute of limitations kicks in. Statute barred is an absolute defence.

Hi lenny01,

With the great help of this site I have sorted out my debts and will be forever grateful to the lovely people who give their time to help others.

In the beginning, my credit score was dismal, so to start with, I got a mobile phone contract.

Then a little later a Vanquis Credit Card.

The most important thing is to spend a small amount each month on it and ALWAYS pay it off.

This I found helped my score improve, but you must be firm with yourself and this card as the APR is very high.

Good luck with sorting out your finances.

blueboy, another thing to watch for Vanquis is the payment dates. You should always make your payment on receipt of the statement rather than wait until the actual due date as there always appears to be a delay in their receiving and applying to the account.. which could lead to a charge being applied.

Hi citizenB,

I totally agree with you and always put dates for payments etc in my diary!

When you have had terrible debts and see light at the end of the tunnel, you feel that you have been given a second chance and I will never let myself get in a state like that again.

blueboy1 Thank you for your kind words and encouragement. I'm glad you got yourself on the straight and narrow, I just felt that approaching the big 3-0 with 3 kids I really need to get mature about money, pay back what I owe and deal with the rest. My partner and myself have really been through the mill the last couple of years (I won't bore you with the details!) and it feels good to actually DEAL with these issues. I couldn't do it without the advice and kind words of the team and members at CAG.

 

I'm just trying now to sort out my partners financial issues which are a bit deeper than mine, and eventually we'll be sorted for the sake of our kids :)

 

I have actually found a new passion through all of this and that is BAILIFFS. As we are currently dealing with one (See my thread 'Equita Problems' - just updated, be good to hear your thoughts brig) and seeing what they think they can get away with and how they bareface lie, we are now preparing a small claims legal package as a matter of principle - I am researching and researching and will hopefully be in a position to contribute on CAG to assist others like I have been assisted.

 

However, I digress, I will keep everybody informed of EquiDebt's response, if any :)

In view of the information you have provided, we have investigated this matter internally and have now closed our file accordingly.

 

We can confirm that this account has now been returned to our clients and you will not receive any further communications from ourselves regarding this matter.

 

We trust this clarifies matters.

I had a letter come from Aktiv Kapital this morning regarding a separate debt for £353.95, this time I emailed the same letter to their enquiries@ email address, and received this less than an hour later:

 

Good morning,

 

Thank you for your recent email.

 

We refer to your recent letter regarding the above referenced account.

 

We have investigated the issues raised in your email, and can confirm that legal action on this account would be statute barred under the Limitations Period. We have therefore taken the decision not to pursue this matter any further.

 

We can confirm that the account is now closed and you should receive no further contact from us with regards to this matter.

 

Please contact us if you have any further queries.

It feels great. These debts have been hanging over me for years. Whilst it is true that everybody should pay what they owe, I feel that as soon as I turned 18, I literally had credit thrown at me and wasn't mature enough to manage that credit. Whilst ultimately it's my responsibility to pay my debts, the creditors should take their fair share of responsibility for their irresponsible lending, and it shouldn't hold anybody (me and others) down from trying to manage their finances more sensibly in the future. And in addition to that - the DCA's that buy these debts and prey on the worse off people in society - threatening those with legal action that could never be enforced, it feels great to get one over on them. It's a nice feeling that they have wasted their money in purchasing those debts.
