      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

stop worrying, i had to do all this and i had letters from where my ex was staying and it meant nothing as he just rented a room , he worked away and this was not enough proof, we still had a joint bank account with a huge over draft etc.

They wont send you to court all they are doing is gathering evidence and if u owe them any money just set a repayment plan up, that is what i had to do.

Believe me no point in making yourself ill, i did and ended up in hospital , and it is not worth it . if i knew back then what i know now, i would have just carried on , take care of yourself and your daughter.

You will be fine i promise ,xx

You must stop worrying you will make yourself ill, all the contact was through phone and letter , have you been to CAB , they phoned on my behalf .

Then they said i should fight my case as it was so unfair, but like you i got myself in such a state, just wanted it sorted , but wish i had.

Why should people pay back money they are entitled to , everyone's case is different, but this forum gives very good advice.

Dont feel ashamed.

all you can do is give them what they have asked and set up a repayment plan if and when they get back to you.

Believe me you will get through this.

I was like you , i had 10 weeks off work , doped up on drugs had doctors coming to see me and !

You will be fine. You will not go to court.

Hi

i have just read all the threads and what you have been told is right, your docs wont judge , they will support you an do what they can for you , mine were fantastic wrote letters on my behalf.

I did not pay any penalties and they looked into 2 years with me.

 

Cab are also very good, you need to calm down as you will make yourself very ill.

I do hope you get this sorted soon and feel better soon.

they will not throw the book at you as everyone says this is not what they want, all they want is their money paid back, you will get through this , sit tight and try not to worry,

easier said than done, i had letters from where my ex partner was staying but was not enough.

When you go to citizens advice voice your concerns and they will help you and def go to see your gp and they will be able to support you in many ways, mine did.

I was like you worried sick, did not eat sleep, did not function.

Believe me you will get through this, i [promise you will and will come out of this a much stronger person.

Are you managing to work . You should go and see your gp and they will be able to help you sort out anxieties. You need some help,

hi am so glad you went to the docs , must have been a big help.

You must start trying to relax, and get this thing about being fined out of your head, i had no proof about living arrangements, only a hand written letter from landlord and that was not good enough, they looked back 2 years on me and i was not fined so i doubt if you will,as someone said earlier everyones case is different.

Once you have your claim sorted and know what you have to repay, you will feel alot better.

you will get there. xx

that is only one tax year, so you might not have much of an overpayment,.

i was given anti depressants, as well as other drugs for panic attacks and something to knock me out at night, i had a huge breakdown, but to be honest it is not worth it, after a few months i just stopped taking them, it is year since all this happened and have just got on with my life, not worth going back, you will get through this and come out the other end, from what you have said you have been through so much, so you are a strong person, have a daughter like myself and she was a big help to me.

You sound as though you have a good gp, they will give you lots of support.

hi , have you any idea how much you will have to pay back,,,, am glad you went to your gp.

Things will get easier, your story so similar to mine, i told no one at work but i found it easier that way.

if it helps i sent everything i could to hmrc and the statements etc that were missing i told them i would forward them on when i got copies and they were happy with that .

hi deep breaths , you must try and calm down , i know it is hard from personal experience.

Take every day as it comes, as soon as you get your bills send them in, and believe me if you owe them money, they will just want you to start paying money back each month.

I coped with the help of a very good friend and fantastic gp, i took anti depressants amongst other things, and i found it helped, but i had so much time off work i had to organise, my day.

I used to try and sleep alot of the time time but that did not help. I used to go for long walks with my dog, i know that sounds mad, my heart used to race all the time.

Take each day as it comes , from what you have said you have a beautiful daughter like myself and she is prob a rock to you, try taking your mind off things , easier said than done.

I can promise you it will get easier, it is a year ago this all happened for me, i never thought i would get over it but u do, i haven't forgotten but time is a great healer.

Not long now and you go to cab they will take a big weight off your mind, big hugs xxx
