    • Thanks for this update. Let's not if you have any more difficulty – in particular if you have difficulty getting paid back from the purchaser. We can help you either against the parcel delivery courier or against the purchaser
    • I'm still waiting for them to kick out sunak and bring Johnson truss and farage in late as it is - as an act of desperation. Tossuss and some others as well as those who were (alleged) brokering a farage ennoblement deal are promoting it aren't they?

So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So after 7 weeks and 2 days of sending off the letter and FOS form I received a PPI offer from HSBC against my graduate loans from 1999-2005.

 

They have calculated a PPI Premium Redress against the 4 loans I chased and oddly enough a redress against the 5th loan which didn't have PPI (HSBC Graduate loan with Protection) and I didn't mention.

 

I think because each loan consolidated the last somehow the PPI became part of the 5th and final loan. (?)

 

Each premium redress has taxable interest added at 8% and the grand total of it all comes to £2,828.

 

I don't have any of the details of the loans anymore (I was given the PPI plan no.'s by HSBC over the phone) so I don't know whether this is the correct amount or how much PPI I was paying each month.

 

1. I know it is hard to say but does this sound ballpark like the correct figure? Each of the loans was less than £4000. (I realise this is probably completely unanswerable!)

 

2. Finally should I just accept the first offer? I am quite happy with it but....I hate to let banks get away with anything ;)

 

Any advice greatly appreciated,

Get them to let you have the detailed breakdown of how the figures are calculated....and I mean Detailed :-)

Hi HS,

 

I had 2 HSBC graduate loans from 1999-2005 (we must be a similar age!) and I paid PPI for a couple of years (I then cancelled it when I couldn't afford it). Unfortunately I've kept none of the paperwork. I've just bought a £2 Equifax credit report but discovered that only goes back 6 years. I've also called HSBC and they've said they only keep records for 6 years. I see from your post that you claimed in 2012 and you didn't have any paperwork. How did you get HSBC to give you the details of your loans given they were paid off over 6 years ago? I called their 0845 number. Did you go into a branch instead? I'd appreciate any advice you have!

That sounds like nonsense. I had no paperwork and they had all the numbers from around 2000 (well over 6 years).

 

I did go through to the HSBC Plus Account call centre and spoke to a Scottish guy and not the Indian branch. (I've got the plus account as I work abroad and it saves on cash withdrawals.)

 

I rang them and asked "what address do I send a SAR request to?" I explained this was because I wanted the no.'s so I could claim my PPI back.

 

He then gave them all to me over the phone. Whether mentioning the SAR triggers some change of response on their part (just speculation and I very much doubt it)?

 

So I'd just get back on the phone, kick off and keep pestering them ;) I think sometimes you have to play "Call centre employee roulette".

Thank you so much for your advice, I really appreciate it! I'd pretty much decided to give up last night, but your message has given me the confidence to call back and play some call centre employee roulette :wink:!

 

I might also try going into my local HSBC branch, as it may be harder for them to fob me off face to face! I'll also look into the SAR request.
