My friend signed as guarantor for his son's uni lodgings in a shared house. His son never signed a tenancy agreement and never moved into the property. He has now decided not to go back to uni. Is my friend liable for the rent? His guarantor agreement was sent to him through the post and he signed and sent it back in the post. Thank you.

If the son didn't sign a tenancy agreement, why was a guarantee signed?

 

Did the landlord or rest of the tenants find a replacement for him in the house share?

 

I am sure the Landlord would have been in touch very quickly if there was rent outstanding, in my experience they don't hang about for their rent!

Was the Guarantor form executed as a Deed?

Son's T Agreement is is valid even if only verbal.

T in effect as soon as first joint T took possession, not so if son had ind room only AST

Rent would be due from son/G until acceptable new T moves in + readvertising/letting costs.

If joint T then ind Gs jointly liable for rent & T damages until son's T reassigned IMO
