I have checked my Credit Report and one of my accounts shows 6 years of late payments marked with a 6 for every month. This is a credit card debt that I could not manage to keep up the repayments. Anyhow they accept £50 every month and have frozen interest. I have phoned the credit card company today and they say that the 6 will be applied every month until the debt is paid off - that will take me another 7 years. If they had defaulted me 6 years ago this would have been off my credit file now but the way I'm going it will take me 13 years for it to fall off.

Is there anything I can do to resolve the situation. I already think I should just stop paying because all those 6's cant be good for my record. I feel like just as I am about to make the final payment they would probably default the account anyhow. Is it much worse to have a default than all these 6's

Try this send it to the Data Controller at the CC issuers head office.

FORMAL COMPLAINT

 

I have recently telephoned your company in regard to the method being used to report the status of this account, markers are being placed showing 6 each month. and I have been told this will continue until this account is cleared.

 

I consider that this is grossly unfair as I have agreed to pay £50.00 per calendar month to clear this debt, had I not agreed to this the account would have been defaulted and would now have been removed from my credit file, this now puts me at a gross disadvantage compared to a debtor who has made no effort to pay anything towards their debt.

 

A defaulted debt is removed from credit files after 6 years paid or not I belive that the Information Commissioners Office believes this situation your company leaves me in is unfair and I am making a complaint to them regarding your companys conduct and will if necessary take the matter to the Financial Ombudsman Service fo adjudication.

Equally as bad as either will preclude access to credit, worse the markers are indefinite but a default gets reoved paid or not after 6 years (rock and a hard place situation).

I wonder if I can get them to back date the default, I am going back years here and now I wish I'd just not made any effort to try and pay this off. I will send the letter and if they don't do anything take a decision of the best way forward.

Get that letter a way then we can progress it if the reply is not compliant.

I am going to get this underway tomorrow.

I have done myself no favors by making regular payments. I will stop payments so that they will have to close the account and default it. They may try and enforce it but this goes back to 2002

I have posted the letter you kindly put on the forum for me. I live abroad so sent it by Special Delivery - it cost €21 but hopefully it will be worth it.

Is there a time limit that they should work within?

14-18 calendar days would be fair, snail mail uk to be taken into consideration.

I would send a reminder after 14 days, normal post.

I have received a reply today from the complaint handler of nat west cards customer services and they say that they are unable to uphold my complaint: as it is a true reflection of the conduct of the account. They included a leaflet about the Financial Ombudsman service

Any advice is appreciated. In the meantime I am going to stop all future payments so that they will have to default me and at least it will drop of in 6 years - unless advised otherwise that is

Agree with Brig - go to the FOS before you cease payments. If you fail to pay and NatWest have their house in order then it leaves you open to a default and then possible court action to collect the debt.

 

Is there a letter I should use. I have a 6 on my report for the last 6 years and at the current rate it will take 7 more years to pay this off so I have at least another 13 years of the 6's being shown. How long does a 6 have a bad effect on my credit file?

I live abroad so the court route is not that straight forward for them
