    • There is no evidence that I was issued a PCN that was placed on the car and removed. It seems that I was issued a £60 PCN on the 8th of March (the parking date) but it was never placed on my car, instead,  they allege that they posted the PCN on the 13th of March and deemed delivered on the 15th. I never got this 1st £60 PCN demand. I only know about all of this through the SAR. I only received the second PCN demanding £100, which was deemed delivered on 16/04/2024 - that is 39 days after the parking incident.  I did a little research and "Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations." as per London Councils Code of Practice on Civil Parking Enforcement.  The main issue is that I was not aware of the 1st £60 PCN as I didn't receive it - I'm not sure how this relates to the 28-day rule because that rule applies to the initial £60 PCN. PCM could say that "we sent him the letter by post and it was deemed delivered on the 15th of March" therefore the 28-day rule does not apply.  As regards the safety of the parking attendant, that is clearly something he chose to feel and he made the decision that his safety was threatened - I didn't even see him or had any interaction with him. I'm nearly 50 and I definitely don't look aggressive 😊

    • Personally I would strongly suggest not risking going there with debts. Very possible you wont get back out again. And I know many in that position. Not jailed just unable to leave. the stories of Interpol in other countries sounds far fetched but in and out of Dubai is not a good idea. only two weeks ago a mate got stopped albeit a govt debt.
    • BTW the time in and out is less than 10 mins, more than 5 in case that's relevant? I saw an article posted on here about a year ago a proposed legislation change but i don't know if that went through or not? I'm also a blue badge holder but there it was a regular parking spot.   Private parking fines to be capped at £50 WWW.BBC.CO.UK Drivers will also need to be given a grace period for lateness, as part of a crackdown on parking firms.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have a problem and wondered if anyone could answer it for me. I used to have an account with HSBC which they very kindly closed in May. On Aug 28th a company called Aqua Pay made a deposit of £250 to my HSBC card and the bank accepted it apparently. 6 weekks on and I am still without my money. HSBC claim they cannot trace the payment so they say that I have to take this up with APbut AP claim that the money has gone from their account so therefore I should take it up with HSBC. AP gave me an ARN number which they claim is commonly used within banking and that with this HSBC can trace the money. However HSBC say they have no idea what this number is and they cannot trace the payment.

So I am very p***ed off and minus £250. What I need to know is:

Who is actually holding the money (and earning interest on it)

Who can I threaten with court action

and what is an ARN number

Banks normally have some sort of holding account for such funds.

I don't think court action should be required, I would ask HSBC what information they require in order for them to be able to trace the money. (Unfortunately I don't know anything about ARN numbers).

 

I had something similar a couple of years ago. Turned out the sending party had transposed a couple of the digits of my account number. I think we traced it using the date and the sort code / account number of the other party.

Thanks for the reply.

I will contact HSBC and see what exactly they need to trace the transaction, although when I went in last week they did try to trace it via my account no and sort code and came up with nothing.

Well I contacted HSBC again and they said that they would do a full investigation and then write to me. I had a reply today stating that they can not find any trace of this £250 payment made on 28th Aug and that I should contact Aqua Pay and ask them to put a trace on it. I had already done this and they had said that it was no longer their problem as they had made the payment, the money has gone out of their account and now it was down to the bank arghhhhhhhhhh

So what do I do now! I'm still minus the £250 and nobody wants to take responsibility!

Any ideas as I really don't know where to go now.

The way I see it is that it is Aqua Pay's problem even though they say it isn't. Look at it this way, if you owed your credit card your monthly payment and sent it to the wrong place, say your mum's account for instance, so it never arrived, your credit card company would still come after you for the money you owe them, you wouldn't say I've paid it so it's your problem to track it down. Sorry that was a bit long winded wasn't it :) !? Threaten to sue AP for the money they owe you and I'm sure they will soon find out where it went if they don't want to end up paying twice!!

It will be AP's responsibility to trace it, it's all very well them telling you it's left their account but if it didn't arrive at your account it will go to holding for a time (6 weeks I think) then get sent back to their account, so they'll have it to pay back to you.

Well this saga is still going on. HSBC wrote and said they couldnt find money go back to AP. Did this got no joy and asked for business name and address to write and complain to. They refused. Rang again and said under Business Names Act they had to provide it so 20 mins later they did! Sent letter a week ago and no answer (no surprise checked companies house and that another story)

Phoned AP again and said this time I would go to Trading Standards.

Surprise Surprise the Manager now going all out to sort it!

Can anyone tell me who are the issuing bank for HSBC debit cards?

well thats what I thought but I dont have the card anymore to check. The manager from AP has said that she has investigated on my behalf and found out that the co-op bank are the issueing bank of the card but I don't understand this so was trying to check.

Credit cards have an issuing bank and if anything goes wrong you contact the issuers ... apparently not the bank so she says

midge I think I can safely say without any doubt that an HSBC card is not issued by Co-op bank. What were the first two digits of the sort-code? You haven't got your card anymore but it should be on the payment advice slip that comes with the statements if you've kept these.

 

Atleast AP are doing the running now by all appearances..

Thanks Bong will go in loft and have a look tomorrow.

What I understood was that if HSBC had taken payment they would have money in a holding account and after 6 weeks send it back to whoever sent it in first place..... namely AP then they should pass it on to me as they should have done in first place. But obviously that would be too simple!!!!!

Well I going to ring AP once again tomorrow but I have insited that they don't try to do refund on any card but pay straight into my bank account .

Hopefully that easy enough to do!!!!!!

You know what I've just realised it must have been my Smile account that the card was linked to..........doh! Did't have it for long so forgot about it so I've been chasing wrong bloody bank!!!!

Phoned Smile they can't trace it either. Phoned AP they say they can't do anything until they get the money back THEN and only then will they pay me. Phoned Smile again and they asked for AP to fax a copy of their BACS trace so they can double check. Phoned AP and have asked them to do this. Had no reply so will have to wait to Mon to chase again.

At this rate won't get the money til next Xmas! What a bloody saga
