We 'd like to know if the debt was sold, as DX has asked.

 

If it has been sold, the bank has no right to set off the refund against a debt bought by a third party.

 

However, you may be happy for the refund to be set off like this. Let us know please.

I understand now.

 

I'm kind of happy with the partial reduction of the outstanding debt.

 

just don't think there is any way out of this, execept to pay up.

 

I suppose what I do now is wait for credit report, might just do the 30 day trial thing with experian, as this is my second request to Equifax.

OK, i've applied to Experian for my credit report.

 

Waiting for pin.

 

Will this show if the debt has been sold and for how much, or assigned ?

 

Barclays told me that Zinc would take payments and then send them directly to Barclays Recovery Unit.

 

if it has been sold, then I woulld agree that they should not have offset the debt with my ppi award.

 

Just worried about ping ponging with a nasty dca again.

Let us know who owns the a/c and since when.

 

Did you ever send Barclays a CCA requesting the loan agreement for the bank loan. If so, what came back.

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN OR USE SEE THRU TAPE OR LABELS]

DO NOT USE ANY PDF EDITOR TO BLANK STUFF, THAT CAN BE REMOVED

DO IT IN PAINT.EXE or any photo editing program

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Well, if you take the whole award being 7.5k,

 

13.5k outstanding minus 7.5k leaves 6k outstanding, assuming that the debt was 7.5k 'too high', (ppi + interest),yes?

 

Should it not be reduced by the entire award amount ?

 

Otherwise I would be paying back 9k,

6k + the 3k which was awarded to me.

..they get their award money back!?

 

Especially considering that 6k is extremely close to the final settlemnt offer I recived from Credit Solutions.

 

I don't think they just made that figure up.

ah i see what you are getting at

 

they cant take the 8% stat int refund off the debt

without you saying so

 

as its your money in terms of the fact that you've been deprived of the int you could have made on the

PPI + INT that they charged you.

 

it does sort of explain that in the letter.

First 2 pages out of 7 from Experian credit report uploaded, the rest is complete utter tosh, not a single entry from Barclays on this.

gosh,what a credit score. lucky me !

In the meantime, i want to cca barclays. Do i send the letter to barclays recovery unit or data centre, or Zinc ?
