Council tax debt over 7 years statute barred letter

Hi guys

 

Hope you can help.

 

A family member has had a council tax bill for a property over 7 years. I understand that as long as a court order has not been obtained it would be statute barred.

 

I am looking for a template letter to send to the council that is to advise that the council tax debt is statute barred but I can only find the unsecured debt statute barred letter.

 

Can anyone let me know what to add to the standard statute barred letter or tell me what to write.

I don't think council tax ever becomes statute barred - its not the same as 'consumer debt' - its one of the 'priority debts' that must be paid. If the money is actually owed - and the council must prove it - it would be a good idea to come to some sort of agreement over payment. If the council goes to court it can rapidly degenerate into a nasty situation

Hi Gaz

 

They shouldn't ask for a liability order for Council Tax more than six years after the Council Tax became due. This is under Regulation 34(3) Council Tax (Administration and Enforcement) Regulations 1992.

But providing they got the Liability Order within 6 years of the amount becoming due then they can collect the balance until it's paid or otherwise cleared irrespective of how long this takes as it will never become SB.
