      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi assisted blonde, I'd be very lying if I said yes... Still trying to sort out the financial mess DWP have made with my transition to ESA. DLA, however processed my renewal within a week of receiving my forms which, as far as I know, is the fastest they've ever done that. They didn't even ask for any medical evidence and I now have two very supportive letters from my consultants wondering why I'm on middle rate care instead of high and why my benefits have been questioned in the first place considering I'm 'sposed to be dead... DWP, in their wisdom put me in the WRAG group on the back of an ESA50 form without asking for any medical evidence as well... I'm in an ongoing battle with BT who are a nightmare... Another ongoing battle with my water company who actually owe me £300...My gas and lecky have been f'ed up and trying to deal with them is almost impossible... I'm completely drained, so tired that I've gone in to an extended phase of insomnia, and to top it all off I've been having abusive phone calls and texts from a so called friend who owes me £250! I gave her my old laptop free, which just needed about £50 to repair fully, although it was working fine if a little slow... I must have MUG written on my forehead :( I'm completely fed up of people taking advantage of me. I must have been an extremely horrible person in a previous life :(

Oh dear you have had a bad day would a :hug: make it better? All you can do is keep smiling and at least you are proving them wrong coz your'e not dead (neither I am and I was supposed to be by now). I am lucky i dont have any major problems with anyone at the moment but I do feel for you. Weather dosnt help either. Cant help, but feel free to have a rant I'm sure a lot of us can relate to the sheer bl...y stress of dealing with muppets at the end of the phone or email, when they just cant grasp simple facts if it dosnt fit the box, common sense no such thing these days.

Have a nice mug of Coco or a nightcap, and tomorrow can only be better. xx

Thanks. Means a lot from you and many others on this site giving me the kick up the backside I need lol... Am going to try another hot milky drink and then try again to go to bed... Bloomin' stairs are killing me though and the prospect of climbing them brings tears to my eyes because I know how very painful and the feelings of severe discomfort, especially as my right hip seems to want to dislocate itself again :-( I really cannot understand how the orthopaedic consultant says it isn't too bad seeing as if I bend slightly it's very easy to feel the right hip joint protrudes in a position it's not meant to be in; totally different from the left although that one is damaged too, both as a result of me getting hit by a car when I was 14 years old; both hips broken and pelvis shattered...xxx

Hope the hips are a bit easier today, sister in law has had hers replaced and then they went again and only recently she just got up one morning and one of them came out again and i know the pain she is in.

Just be careful, no break dancing !!

BTW any chance of you getting a stair lift put in?

In case anyone's still got problems with the time on the site this should sort it. :-)

 

We often have this trouble, and different users have been experiencing different things - even with identical preferences.

 

 

 

 

 

Anyway, if you're seeing times an hour out (this post was made at around 13:55 BST), go to UserCP -> General Settings, and there are a couple of options there. You probably have your timezone set as GMT (if you're in the UK), and DST Correction set to "automatic". Try changing DST Correction to "always" .... should fix it.

I just finished painting a fence this morning NO :)
