    • Sorry to ask, but I know I had SB template on PC, but can't find it. Also any search for template\SB letter takes me back here.  Any help to get to SB letter would be appreciated. I know I used it on a car HP co that wouldn't honor my FCS refund and after 6 years came threatening ( or rather their DCA). Worked a treat. Thanks in advance

    • Good evening. Hoping to keep this short and concise. Any help really appreciated! Sent originated from council tax in 2019.  I moved address for a new career 240miles away in December 2019 and have lived here ever since.  A distant friend resides at previous address.  A CCJ was filed regarding this debt in January 2020 but no correspondence was received my end or at the old address.  Move forward to this year; early April I learn of a letter received from Bailiff - Notice of Enforcement dated 13/03. Stated I had ten days to settle a payment/payment plan or £75 will be added after ten days from 13/03 and bailiff instructed to visit.  Obviously I was unaware of this letter till well after the time period passed. Attempted to contact Dukes via email but zero response. Asked for breathing space in order to check the original debt with the respective council (I wasn’t awarded a week of Housing despite being on UC for a short period due to a contract date given by the old employer).  29/04 a note was left at the old address stating a bailiff had visited. New balance £310 more than original outstanding.  I’ve since contacted both the council and the bailiff agent to state I’m more than happy to settle the original debt over a payment plan but at this stage they will not remove the fees despite all correspondence not being sent to me and obviously me only seeing them much later than one would have expected.  Tried live chat today with the company and firstly was told the fees will remain because I spoke to the enforcement agent - I have never spoken to him/her.  secondly told the fees would remain because “I tried to use their web chat service to complete an income form” - I have zero recollection of doing this and I also wonder if it’s another tactic? any help on where I stand with the fees added would be incredible. Thank you
    • the evidence you have from Mercedes is perfect. simply write to both the finance company and the dealership that sold you the car, stating under the consumer rights Act 2015 should a fault appear outside of 6mts, it's for the consumer to prove the fault was present at time of sale. Please find enclosed a copy of said report from Mercedes at XXXX stating quite clearly that the windscreen was replaced on Date , some xxx months/years BEFORE my purchase on DATE. there is a bill to pay of XXX to XXX , i expect you to sort this out between yourselves , i am not liable for this. something upon those lines anyway.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I HAVE SEARCHED THIS SITE FOR HOURS, READING ALL THE DIFFERENT THREADS, AND ALL THE DIFFERENT PROBLEMS WE ALL HAVE WTH ABBEY AND HAVE FOUND THE SITE EXTREMLY USEFUL.

 

I FOUND THE SITE VIA GMTV'S WEBSITE WHICH DIRECTED ME HERE. WHILST ON GMTVS WEB SITE IT HAS SEVERAL QUESTIONS PUT THROUGH ONE OF WHICH IS 'WHAT WOULD BE THE BEST THINGS TO PUT IN A LETTER TO THE BANK?

 

The reply states that there are 3 copies of letters done by campaigning groups and are linked to from an article on the website.

 

CAN ANYONE HELP ME FIND THESE COPIES OF THE LETTERS? I HAVE SEARCHED FOR AGES BUT I KEEP GETTING SIDETRACKED ONTO ALL THE OTHER HELPFUL INFORMATION ON HERE.

Think i posted this in the right place, not sure though!! Feel free to shout at me if i havent!! :p

 

My Story:

 

A freind of my'n watched GMTV a few days ago and the subject of 'Unfair bank charges' came up on the show with a man who won his case after taking ABBEY to court. As soon as this freind told me about it, i came straight on the web and started searching and got directed here.

 

My bank have been ripping me off for years, and now i am aware that what they are doing is incorrect i am going to do something about, because at the end of the day, Its My Money.

 

I have only been on here a few hours, and have found so much information that i didn't realise how wrong ABBEY are and how easy it is for me to do something about it.

 

Im planning on getting the first letter sent out to ABBEY by the end of the week, and see where it goes from there.

 

Il keep you all updated, and want to give a BIG BIG thank you to all the people that have helped me with my queries so far (as i had quite a few!)

Any info would be gratefully appreciated:

I made a complaint to ABBEY back in May PRIOR TO joining this site.

They have sent me out a response to my complaint stating they are sorry for my complaint and have offered me £240 even though i only asked for £120 to be refunded. In my complaint letter, as i did not know of this site at the time, i only complained of the charges for May & these are the charges being refunded. In the reply letter ABBEY and stated that this is a full and final settlement of my claim.

Should i take this settlement (For May)? and still go ahead and send the letter asking for my statements and only claim for the past six years (missing out May)? or should i reject the refund and start a fresh new claim for all of six years?

 

I dont know if to take the refund for May as my complaint letter was only for the charges made during May, or will this go against me when i try to claim for previous six years as they have stated it is a full and final settlement?

 

Please help, id like to take the £240 for may and still go ahead with a new claim, but if by accepting this it is going to go against me, id rather wait and claim for the full ammount over 6 years.

No, i made the complaint to them before finding out about this site. so it was just a letter of my own explaining that i was unhappy with the charges made for May.

 

They have attached a standard letter that i have to date and sign:

 

I acknowledge receipt of your offer to refund charges totaling £240 and accept it in full and final settlement of my complaint. Please arrange to refund £240 of charges to my Abbey Current Account. These debited my account in May 2006

 

Signiture...................... Date..................................

 

I am still going to send out the letter asking for all statements and requesting a full refund of all charges made, but i wernt sure that i would mess up my claim if i signed the letter accepting the Refunds for May.

 

If it does not make a difference then i will go ahead and accept the refunded charges for May and then proceed with all the other charges over a 6yr period, i just wanted to make sure before i accepted as if it does go to court, then i did not want them to bring up in court that they had alrady refunded me some charges (Mays 2006) and that i signed an agreement stating i agreed to those terms and cannot proceed with my claim.

 

Thanx for your reply, i will go ahead and take my money back for May, and then proceed to reclaim ALL the rest of my charges over a 6yr period

Now that was something i didn't know, thank you so much.

 

I thought i had to sign their letter in order to receive my refund, but i did not want them to bring it up at a later date as i thought it may go against me later on.

 

I will type up my own letter accepting the refund.

you dont have to sign the letter you can send you own letter (email)on your own terms.

remember to put "WITHOUT PREDUDICE"at the top

 

You certainly don't have to accept it on their terms, but it does not necessarily mean they will accept it on your terms, although they might well do. If they don't agree to refund on your terms, just put it on your 6 year claim. It makes no difference at all to your claim whether you take it or not, as the whole lot are unlawful regardless.

 

I would not put "WITHOUT PREJUDICE" on anything, because it could not be submitted in court as evidence, and if it came to it, you could submit it as evidence yourself that you have tried to settle with them. People generally only put that if they want to keep it out of court, but you have nothing to hide, so I suggest you leave that off.

Finally received a reply from 'Abbey', regarding my claim for six years of statements to be forwarded to me. In their letter of reply it basically states that all transactions are held on microfiche. (Suprise Suprise!!)

 

I have now printed of the microfiche argument template held in the library and am going to type it out this evening and post first thing tomorrow morning. Im hoping that they will finaly realise that i am not going to let the matter drop and take the matter a little more seriously and just forward me my statements as i first requested in my first corespondance to them.

 

After i have posted them the microfiche argument letter, do they still have what is remaining of the 40 days (07/07/06) from when i sent out the orginal letter to reply, or do i start the 40 day ruling again?

 

I will keep you all updated and hopefully i'l have some good news in my next post.

Hi

Can anyone please help?

 

Since joining this site i have informed many freinds and family of this web site, and now my partner has decided to take action with his bank 'Barclays'

 

He sent off his first letter and they replied with a rather nice letter informing him that they will send out his staements for the past six years, and because he is such a valued customer of theirs they returned his £10 postal order.

 

Now that Barclays have returned his £10 fee, do they still have 40days to comply with his request or can they now take as long as they like? He sent his letter of on the 05/07/2006, but still has not received any statements.

 

We are not sure on what action he should take next.

Should he wait a few more days and see if they forward him his statements?

Should he now send them another letter?

 

Any information you have would be gratefuly appreciated, as my claim with Abbey has been straight forward so far, but not sure what to do next with 'Barclays'

As if!!!! Had fob off letter after fob off letter!!

As it goes, i went through a hugh box of old letters that i keep dated back to 1999 and all of my 'Abbey' statements were in there. So abbey can keep sending out all the info they want, i now have what i need!

 

Cant wait to see their responce to my third and hopefuly final letter asking for refund.

Hi Becky - brilliant - it pays to hoard these things away - I know I'll be filing things a bit better than in B for Bin in future !

 

where are you up to with your refund letters now ?

 

Sent out a letter thanking them for their speedy responce! (NOT!) AND included in the letter all the charges i require to be refunded with all the charges highlighted on my photocopies of my statements.

 

Ha Ha, i didn't need their help in the end anyway!! They kept fobing me off sending me information that i didnt require so i then had to send out other letters informing them of incorrect information given and to request it all again. Im sure they knew what i was really after, but i think that they are just trying to bide their time and hoping that i get fed up and wont persue the matter.

 

Abbey can think again, I will win (Eventually!)

Hi I have just received a letter stating that they will refund my money asked for but only as a goodwill jesture and will only reduce each charge they have added to 12 pounds so that they are inline with OFTs recommendation. They will then add the refunds to my account.

 

Should I accept this offer and if i do, should i still send them a letter before action and then take them to court if need be?

 

Please help as i do not want to proceed to court if need be and loose as they have refunded me the ammount but are still charging me 12pounds and only refunding me the difference.

 

Please note that the letter received is from Capital One but I only have a thread open for abbey. Abbey still have not replied to request for refund of payments and am sending the Letter Before Action Tomorrow 25th August 2006.

Hello Becky

 

You may want somebody elses advice on this, but I would refuse that, as the £12 is only the point at which the OFT will get involved.

 

You can bet your bottom dollar that their costs are still far less than this £12, that is why they are so keen for you to accept it. They still have'nt told you how much it has cost them? That is what the argument with all these unlawful charges is all about, until these bank & credit card companies stop profiteering from these charges, then they still need action to be taken against them by the likes of us!!!!

 

I would keep going for the full amount, but again, that is only my honest opinion!

The £12 was a "maximum" they could charge. Anything above this will automatically trigger an investigation by the FSA. Also remember that even after the FSA / OFT told the credit card providers that the maximum charge should be no more than £12, the banks said it did not apply to them...... contradictions or what? It is still unlawful however. Whilst I cannot advise and would not, my thoughts on this is to reject and carry on.

 

Abbey as well as the other Banks are trying to coerce, bully, intimaidate you wherever they can in order to get you to abandon what is rightfully yours... do not give up.

 

You will win and you will not have to go to court providing you follow this sites guidelines and recommendations using the templates provided and not deviating one iota unless you know what you are doing.

 

Stay in there and don't worry :D

Has Anyone eles got any suggestions? I am hoping that what Phil has said is correct and i do not want to accept the offer but want all of my money back as it was myn in the begining! But i dont want to refuse their offer and when it gets to court it goes in their favour as they have offered me a good enough ammount that is inline with the OFT.
