    • Have we seen your court bundle?   If we haven't then it's probably an idea to post it up here especially the index page and the witness statement so we can see if there is anything which might need adding or changing 
    • "Care to briefly tell someone who isn't tech savvy - i.e. me! - how you did this?" Its pretty simple although not obvious. You open the google maps app > click your profile picture > Click Timeline from the list > click today > choose the date you want to see the timeline from. Then you'll see your timeline for that day. Often, places you have visited will have a question mark beside them where google wants you confirm you have actually visited. You either click 'yes' if you have, or you click 'edit' to enter the actual place you visited. Sometimes, you'll see 'Missing visit' This probably happens if your internet connection has dropped out at that time. You simply click 'Add visit' and enter the place. The internet on my crappy phone often loses connection so I have to do that alot.   OK dx, understood mate. 
    • I have now been given a court date vs Evri, 4th Sept 2024. I have completed my court bundle, when am I expected to send copies to the court and Evri and should it be in hard copy or electronic? The Notice of Allocation states that no later than 7 days before the directions hearing both parties must send to the other party their final offers to settle. Does this mean I will have to tell Evri what I'm willing to settle? Rgds, J
    • Ok how about this to the CEO? I know it sounds super desperate but lets call a spade a spade here, I am super desperate: Dear Sir, On 29th November 2023 I took out a loan of £5000 with you. Unfortunately very early into 2024 I found myself in financial difficulty (unexpected bills and two episodes of sickness and the tax office getting my tax code wrong resulting in less pay for two months) and I contacted you (MCB) on 13th February 2024 asking if there was any way I could extend the length of my loan to 36 months. I fully explained why I was requesting this and asked for your help. I did not receive a reply to that email so I again contacted you on 7th March 2024 to advise you of a change in my circumstances which resulted in me having to take out a DMP and asking you to confirm that the direct debit had been cancelled. You would have also received confirmation of this DMP from StepChange but you did not acknowledge receipt of my email. I have only managed to make one payment from my loan but did try and contact MCB to discuss extending my loan, help etc.  I have now therefore fallen behind on several of my debts, yours included, and as a result you have lodged a Cifas marker against my name for "evasion of payment", which has resulted in me having to change banks, which has been an extremely difficult process because of the Cifas marker. I do not feel you have been fair or given me the opportunity to fully explain my situation to you before you lodged the marker against my name. I appreciate it is a business and you have acted accordingly, but I did try to make contact to arrange alternative arrangements and at no point, not even to this day, did I ever intend to not repay my loan. I cannot stress to you enough how much this has affected my mental health. I am having trouble sleeping and my existing health condition has been exacerbated by all of this. What I would like you to do is to please, please remove the Cifas marker and let me make arrangements to pay the loan back through a DMP.  Please sir, I am begging for your help here. I am not a dishonest person and I have never been in a situation like this before. I am desperately trying to make things right but this marker is killing me. Please can you help me?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:sad: My natwest account was running ok until about 3 months ago when they charged me nearly £3000 in one go in charges... it ate my benefits for 3 weeks and they wouldnt give it back, as a result, i withdrew my money as im a single mother and its ALL i have to live on. Now theyre charging me over £50 a month in overdraft interest and permanent charges time after time and i have virtually no money left to pay them the money back in on go as they ask... Please someone tell me what to do! I cant live anymore on the money I have and they are charging me a fortune and have already taken a fortune in charges... please????:sad:

That does help, thank you... Iv got a new account with barclays and withdrawn my money etc... but theyre still charging me £50 a month in interest for my overdraft as its getting higher and higher... My overdraft only started @ couple of hundred as my bag with my cheque book etc got stolen and i wasnt sure what had gone missing! Is there any way of claiming back the interest charges as my overdraft is getting higher and higher and their interest is as well... Can I ask them to go to debt collectors with it? Or should I go to the cab and ask them to arrange something with the bank? x

Let them keep charging you. If you have not got any money going in, and then start proceedings against them along the lines of the CAG Forum, it does not make any difference. You just claim it all back plus charges you may have accrued in the last 6 years.

 

There is a letter I believe that you can send to the bank to get them to stop as the account is now in contention and no more charges etc should get levied. Have a look in the Library. Sorry do not know how to do the link.

 

All the bank will do is write off the charges if you claim up to when you stop using the account. If they don't claim theose as well and make the bank pay themselves back. Does this make sense?

sgc- having read the title and what happened in your cirumstances I have to say it is a bitter pill to swallow for me, as a member of staff. The first thing I did was straight into the chatroom to ask the guys in there to give you some advice because the last few lines on your first post got to me that much. I am so pleased that Karnevil, rose, motb and sharmal have been able to help. At least today things do not seem as bad as yesterday and you seem in better spirits. My advice to you is that if you ever get to that point again pop into the chat room as ask people in there. It may seem daunting but they are fantastic and always willing to help. Keep the chin up, the CAG family can always help.

I sent this a letter along these lines:

 

ACCOUNT NUMBER: XXXXXXXX

I today received your letter dated the ********. In it you informed me that you have referred my account to Westcott Credit services Limited for recovery of the debt.

 

This account is in dispute. I have been corresponding with Mike Brophy head of customer relations at your London E14 address.

 

On the ******* I issued a summons at *************** for the recovery of ********** from yourselves, which has been unlawfully removed from this account during the last 6 years.

 

As you are no doubt aware to refer an account, which is in dispute, is a clear breach of section 13.6 of the banking code, which you are a member.

 

I also note from your letter that you have registered this information with credit reference agencies. You have a responsibility in law to ensure that personal data that you hold is accurate, relevant and up to date. The fact that this matter is in dispute is both relevant and makes any entry on a credit file inaccurate.

 

These matters I consider to be a serious breach of both the banking code and the Data protection Act. I require you to immediately to remedy this situation by.

 

· Recalling the debt from Westcott Credit Services Limited.

· Removing any reference to this debt from any credit reference file.

· Inform me in writing within 7 days that you have done this.

 

If the above is not done within 7 days I will make a formal complaint under the Banking Code and to the Information Commissioner.

 

I will also inform the district judge at Northampton County Court who is dealing with this matter. I am sure they would take a dim view of such threatening behavior prior to a county court case.

 

This letter is in confirmation of a phone call I had with Eamon McManus of your collection centre today at 11.50am. I relayed the contents of this letter to him who undertook to deal with the matters raised.

I dont know that the letter by mum of three boys will help. Certainly if you have got all your money out of this account and got a new one then the bank will have to accept what you give them. If they are not happy withthat then they will probably get debt collectors in. Not to worry about that now though.

 

First thing to do is write a S.A.R. to NatWest asking for all statements etc going back 6 years. The letter is in the Bank Templates Library under Data Protection Act - Subject Access Request letter - list of charges.

 

Put your own details in obviously, and then you will need to send it recorded delivery so you can prove that it was signed for at the other end. That will cost you a £ and you fill out red slip in P.O. not silver one like I did.

 

Also you will need a check or Postal Order for £10.00 as per letter.

 

I will keep looking so keep updating.

 

Also write to the bank or pohone them and tell them that you will be depositing xxxxxx until everything is sorted out.

Ok, sorry to ask again but iv just completed the court forms mostly apart from exactly what im claiming for... the charges are £2282.22 and the 8% is £145.09... I know I claim for both parts of this... With regards to the interest im unsure exactly what im claiming for... the "interest on penalties" column adds up to £150.40 and the 8% on the interest part adds up to £2.97... Do i just add both these totals onto the other two totals or just one of them? Can someone who has claimed for the interest please tell me? x

Hello SJC

 

I'm really sorry you didnt get responses to your questions in October, presumably you did some studying and worked it out.

 

Whilst you await their defence, do some further reading on the next stage.

 

The chances are you will start getting offers soon.:) The Allocation Questionnaire follows receipt of the defence, I received mine some 2 weeks after I got NW's defence but, depending on the court, you could receive it sooner or later.

Hiya, yes i read loads and muddled through... I used the template from here to fill in the particulars of the claim. I had done my parents for barclays and they have just settled but id done that quite a while before mine so im stuck now iv got to mine again, lol x

Absolutely normal cobblers from cobblers. You don't have to do anything now. The court will send you an AQ (allocation questionaire ) Which you fill in http://www.consumeractiongroup.co.uk/forum/general/53570-new-strategy-allocation-questionnaires-3.html. Youwill then be dircted by the court. Cobbetts defences are quite intimidating to scare you into submission. Good luck.
