Hi,

 

I have an RBS bank account which is not my main account, and which has been at my mums address for years. At some point shortly after I was released from a mental health ward in 2009 I apparently changed it to a royalties gold account. I have not been using the account since, but due to the account fee and subsequent overdraft charges I have now found on opening old post at my mums that it is overdrawn by more than 1700 pounds and they are threatening debt recovery.

 

Can i make a CCA request in this situation? I honestly don't remember signing up for it but due to my mental state at the time I can't be sure I didnt. If not what are my options, and if I ask nicely what are the chances of them waiving at least part of the debt?

I posted this in the wrong forum sorry, someone has already suggest in that thread that I send them an SAR which I will do but I would appreciate any other advice anyone can give thanks.

I think that the best thing to do is to send the RBSlink3.gif an SARlink3.gif in order to get as much of the full history of the account as you can and then go from there.

 

I am especially interested to know if the account was ever used and if the debt is comprised merely of accumulated unpaid account charges.

 

Have you ever explained your mental state to the bank? What did they say?

 

Have you approached the bank about the level of debt on it and about the charges? What did they say?

CCA requests don't apply to overdrafts I'm afraid.

 

Do the SAR and we can then start to understand how unfair they are being and then we can decide what action might be best.

I've had exactly the same issue twice now with RBS since opening my Royalties Gold account. It seems they ARE in breach of BCOBS by doing this, as they state that the charges are for an unauthorised overdraft. However, this is incorrect as you did not request an unauthorised overdraft. You went overdrawn simply because of THEIR charges. I'd write to them stating that you do not believe they are treating you fairly in this matter and that you will refer the matter to the banking ombudsman should you not receive a FULL refund of all account charges.

 

Out of interest, over the last 12 months I have had over £1,000 worth of these charges refunded by RBS along with compensation for the distress that this has caused me. I have also forced them to amend my credit file with all the major agencies in order to reflect the true picture of my finances, as they were reporting my "overdraft" to them. Good luck and don't give in on this matter as you are more likely than not in the right!
