      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok guys and girls.

I bought a car recently where the seller stated it has tax till may 2012 but there little boy nicked it and lost the tax disc. They hadnt bothered reapplying as it happened recently.

 

Anyway being suspiscious i did my checks and the seller was correct the car had tax.

 

So now i purchased the car and i need a replacement tax disc. As you do i called DVLA and this is what the guy said.

 

'yes you can pay £7 and goto a local DVLA office and apply for a replacement'

 

So i called again 10 mins later as i didnt ask if i need any documents. This time i spoke to a woman and this is what she said....

 

'No sir as your not the original owner of the vehicle you cannot apply for a replacement tax and you must buy a brand new one'

 

So i then asked whys that and she said 'because the car is not in your name'

 

So i then said can i wait for the car to come in my name and then go get the replacement. And she repled

 

'No sir you cannot, you HAVE to buy a new tax disc'

 

So my question is, i paid for the car knowing it had tax obviously haggled the car price down but not the point. Someone has paid for the tax and its valid till may 2012. Can anyone please who may know if its ok if i just go with the green new keepers supplement to prove im now the owner and apply for a replacement tax for £7 instead of (£245!!). Im 80 mile round trip from the dvla office!

if you download and fill in form V20 [DVLA site]

that will do.

 

V20 allows you to do this even if you are becoming the registered keeper

Hmmm it says the following:

 

Who can apply?

If you are the registered keeper and have the full V5 logbook in your name

OR

If you have just bought the car and have the v5 new keepers supplement AND

you have the tax disc to hand.

 

I dont have the full V5 yet and i dont have the original tax disc...

To update, i went to the dvla and i told a small porky. I said i bought the car with the tax disc and i miss-placed the tax disc before i could display it. Reason i said this was incase they rejected me for a replacement. Anyway as per above... they gave me a temp tax disc that will end 31st jan 2012, dvla mentioned they just want to buy time incase the previous owner tries to get a refund. They said they will send me a tax notice through the door or something. Not sure exactly as it was so busy there. Will just wait and see what comes through the door in due course.

Yes oh and by the way i had to fill in form V20 and V62(as its not in my name yet) but only pay £7 fee. and NOT the £25 fee the V62 required. (as i have the green new keepers supplement part of the v5)
