Hi everyone

 

I recently took out a home insurance policy with dial direct after the kwik fit fiasco, got a good premium but when they sent out the paperwork I forgot to return the signed credit agreement now they want to charge me 15 quid for not signing it and told them over the phone that because of there attitude they could whistle for it (on principle of course), now they've sent me a cancellation charge for a policy I never signed for , am I going soft or is this another gang of idiots trying it on again, because as I see it no signature no agreement therefore I owe them nothing.

If you did this over the phone, there could be a recording of you agreeing to the terms and conditions and saying 'yes' which makes it a contract ie an agreement. You don't necessarily need a signature for a contract to be formed.

 

Having said that, they would also have to show that you were told there is a cancellation charge and the (others do it so we will) admin charge. If you were not aware of them then they can't enforce.

What is the cancellation charge?

You could request a breakdown of the figures for this asking them to show it is not a penalty charge.

The failure to sign the agreement and their £15 charge is still 3 quid over what the OFT accepted as a default charge for credit cards.

Most have used this as a yardstick for other default terms.

So I would ask them to justify this charge too.
