    • So if the breach occurred say Dec 2017 (first missed payment) and the default notice was issued Sept 2018 and the claim was issued 7th June 24 the claimant will of course be arguing it is within the limitation period (by 3 months)
    • Yep, I would  have brought up the other things like asking for their contract and receiving no response etc. but the mediation phone calls were rather short. Evri just said the contract was not with them (i said 1999 act response etc.) and the goodwill offer thing. Whole process took about 10 minutes in total. Seems like they don't even want to negotate in mediations anymore. "they're only given a certain amount that they can agree to in mediation per day" I mean its hard for me to say if thats the mediator paraphrasing or aa direct quote from evri I will look through that thread and share what I find, also for what its worth I also have everything I made for the previous claim WS and bundles etc. that I can tweak for this parcel, since it did go almost all the way to court and is a virtually identical case. that + this new stuff you shared above should be helpful to me
    • If I haven't referred to it before then please check out this thread another case where the claimant contracted directly with Packlink for a courier delivery service carried out by Evri. Please read this thread very carefully and eventually you will get to a point where the claimant – our OP – discovered some interesting terms and conditions and has referred to them in his case. He incorporated these into his witness statement and was given judgement – not on the basis of rights of third parties but on the basis of direct responsibility. I would suggest that use the witness statement as a model although we will want to see it before you file it off. When you find the particular post with the witness statement, please can you post a link to it here as well as a copy of the witness statement because I don't have the time to look for it at the moment and the thread is rather long. However it is very important to you and you should go through it very carefully indeed. We have applied for a transcript of the judgement and hopefully it will be along in six weeks or so. As soon as we receive it we will make it available on this sub- forum.
    • Yes they are criminal charges. The law requires you to stop/report if "...owing to the presence of a mechanically propelled vehicle on a road or other public place an accident occurs by which— [injury or damage to a third party or their property is caused]. "I would be disinclined at this stage to offer anything more than you do not believe any such accident took place.  You could provide a brief description of the altercation in an attempt to explain why another party might be making these allegations. I know it's a silly question, but are you sure that you did not collide with anything? Could you have mistaken hitting something for the other party thumping your car? Could it be that you passing closely caused him to damage something somehow?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has Anyone some information on Viking Hellas airline? whats going on?.

i booked a ticket on a flight Athens -Manchester on 20 /10 /11

Due to strike the ticket been exchainged for the flight on 27 /10/11

On the day of a flight ,when all passengeres come to airport they were told -there is not any flight today.

Why ? No any explanation.

Now 3 days later, still no any information.

All phone numbers in Greece do not reply, in the U.K. their representative have no information at all, keep sending as to headquoter in Greece where as we remmeber no replys at all.

 

For me these looks like beginnig of bankruptsy, but ....

the question what i suppose to do? The money for the ticket already have been paid...

Any chance to return?

I booked the ticket here, in England, through Flyvikinghellas.co.uk website, using Natwest debit card issued here in England as well.....

Today even e-mails wich i tryed to send them were failed to be delivered.......

sad..... £135 gone....,,,

I am in exactly the same position i was due to be on the cancelled flight from Athens on the 27th as well,I've sent viking 2 emails(to a email address i was given over the phone by a representative) to no avail.I have tried to contact the European consumer right commission as the caa couldn't help me because i was flying from europe not the UK and i'm still waiting for a response from them.I'm 500£ out of pocket due the this flight and 2 others i had to fork out for the following day to get back to Manchester.

anyone got any advice??this has been going on for nearly a month now

Dears Marthara and Rachel,

 

I am with you on this. I purchased two flights, MAN>ATH and ATH>MAN, and was due to fly out on the 23rd December with my sister and her partner (who are also chasing this up). Viking Hellas failed to inform us that the flights had been cancelled, and it was by pure chance that we found out two days before we were due to fly out. As a result, we purchased new flights at a dear cost - this is the most expensive Christmas I can remember.

 

Ladies, my first advice to you is to see whether you paid be credit card, as you may be able to claim the money back from yur bank. Secondly, legally, we are required to write a formal letter and send it to the HQ in Markopoulo. In this letter you must quote EC regulation 261/2004. This is the first step in initiating a legal procedure. Make sure you keep a copy of this letter.

 

I suggest we watch this space, and see if we can collectively pursue legal action - in these cases, it's best doing this collectively rather than as an individual.

 

Rachel, did you have any luck with the European consumer right commission?

I'll be watching this thread as I'm in the same position. I was due to fly out of Athens with Viking Hellas on 22nd December 2011 and back from Manchester on 6th January 2012. By chance I found out 10 days previously that the company had gone bankrupt. Since I live in Greece I contacted the passenger rigths people at tha Civil Aviation Authority here, but they were as much in the dark as me.

Anyway, I wrote to Viking at Markopoulou in Athens quoting the European regs but the letter has come back unopened and marked " They left" by the Greek post office. So, good luck to you all!!

I've just found this on their alternativeairlines.com. It's not much, but there is at least an address on there.

 

Update December 05th 2011

Viking Hellas has ceased to trade with its three aircraft being returned to the aircraft lessors. There is currently no information available as to what financial arrangements have been made to deal with outstanding creditors and it is unclear what legal status the company currently holds. It appears, however, that there is no likelihood of the airline restarting operations in the way described in their press release published on the 15th November 2011. Passengers seeking advice as to how to obtain refunds for unflown flights should deal directly with the travel agent though which they bought their flight tickets or write to the Head Office address in Athens: Viking Hellas K. Papadimitriou 33, 19003 Markopoulo, Athens, GREECE.

Dingledo, thanks for the input. I also wrote to their Head Office in Markopoulo, and my letter had the same fate as yours. Have you had any further luck with the Greek Civil Aviation Authority? Is there another consumer protection agency / organisation we can contact here in Greece? Although I live abroad, I am Greek and am happy to call any Greek agencies that may help us.

 

As mentioned in my last post, the bigger the force, the better the result, so I urge everyone who's been affected to step forward and leave their comments on this thread.

This is long sorry..

 

My partner bought a ticket and flew to iraq no problems.. However a day before his flight back to the UK he had a phonecall telling him his flight was cancelled and that

he should purchase a new ticket and he would be refunded for some of his ticket and his new ticket..

I immediately contacted viking hellas UK n they couldnt tell me anything other than the flight was cancelled n to contact the HO which like others have said you cant get through.. I also rang manchester airport to see if they had any info

I managed to find him a ticket luckily for a few days later!

This all happened back in October last year and up till now we still havent heard or received anything back.

Hi guys,On 26 of October 2011 I booked 2 flights for 2 passengers from Sweden to Iraq via Viking Hellas airline and the flight didn’t go as planned (airline didn’t show up at the Malmo airport). I tried to contact the airline through their email and phone number (on their website) but there is no response. Since the airline was not responding I contacted my card provider and the bank did a reversal to my account.Hope this also work for you guys too if you have booked your tickets online.

In October 2011 I purchased four tickets from one of the Viking's agent here in the UK and paid £790 in cash for Manchester-Iraq and Vice versa.of course this never happened and the company had gone bust and not contactable and the agent can't help too . I had to purchase another four tickets from Turkish Airline and paid £1200. I contacted the Greek's Transport Ministry and this is what they said : NOT MUCH REALLY:

Sorry I didn't get back to you.I wasn't checking. I don't know of any other consumer protection groups in Greece. I hope you jhave managed to get somethimg sorted out. Luckily I got a refund from the bank as I paid by credit card.
