      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can you help?

 

I have recieved a statement from Lowells,

stating I owe money due to an old Natwest Account.

 

This has arrived shortly after a letter arrived from NAtwest

and a letter stating they sold my debt to Lowells on 30/12/2010.

I got the letter 20/10/11.

 

Silly me called Lowells stating I know nothing about this .

 

They told me the account was opened in October 2002, and defaulted in dec 2005.

 

I never got any letter from Natwest chasing me and I think this has been sparked

cos I opened a joint account with the recently.

 

However I did state that I had another natwest account which isnt in debt

so why would I have this, and they gave me a loan which I never defaulted on

and the details they provided me with is not even my sort code.

 

I told them I will deal with them no further until they have produced a credit agreement

and not one they will cobble together, with my signature on it, and until then they write only.

 

but the 6 years is almost up so Im lost what to do?

If the 6 years is up since you either acknowledge or paid and it isn't showing on your credit records it is more than likely statute barred and Lowells are trying it on.

 

There is a statute barred letter in the CAG library if you feel you need to respond. Otherwise, just let Lowell prove that it isn't ?

Can anyone help me on this I received this email today... no idea what it is for. The only possible debt would have been over 7 years old to which I never acknowledged. Or is this spam? - It did have my full name on this

Did you ever send of the SB letter that was suggested by citizenB over two years ago?

 

No I didn't send an SB. I have never acknowledged this was my debt so since it's now 9 years old (nearly) is it SB from 2005 or when it was sold in 2010

 

I have just dug out all of the info. bascially It was left with the DCA via telephone that I have no knowledge of this debt, I already have a natwest account & that you sending me a bank statement referring to this debt does not constitute as belonging to me.

 

The woman of the phone said at the time I am sorry for the confusion we will remove you from this file.

I think the reason I have received the email today is:

 

Yes it is the debt they tried chasing in 2011, there was a bank statement they sent when I stated I had no knowledge of this debt... I found this out today along with their previous letters (by post)

 

on bnk statement: There was a default fee applied by bank in 2005. However they carried on with this until 22/04/2008 (where it states BAL transferred to BDD FINCON £0 OD). However this bank account was taken out in Scotland. I am now in England.

 

I have never acknowledged this and as previously said I fired the data protection act at them & as they have only sent a bank statement it doesn't prove it's me at all..... They couldn't provide anything else and said they would close the case....

 

However they sent that fishing email today... (first communication since oct 2011)

 

Which is where I don't know where I stand does this fall under scottish or english statute barred.... tempted to just wait, then send SB (but id be risking it if any other letter arrives before 22/04/08 - if that's what they are going by).
