Out of the blue today I received a county court claim form (Bradford) from the dreaded Farifax Solicitors acting for Arrow global in respect of an old bank account I have not used for 6 years and 7 months, having checked on here and read a few posts I signed up to Equifax and checked my credit file the account shows a default in March 2006 both with Lloyds and with Arrow global so I guess this is when Lloyds sold it to Arrow Global as no other payments are showing against it.

 

So quite simply do they have a case as the default is less than 6 years ago or do I have a case as I have not acknowledged the debt for over 6 years..........

Hi and welcome to CAG

 

As I see it, they are using the date of the default notice as the cause of action which being March 06 would be within the SB limit however the Information Commissioner states that a default should be placed as early as possible and certainly within 6 months. So, Lloyds failed to file the default in a timely manner. Whether this is a legal argument is another thing
