    • Interesting question regarding what Government accounts opposition parties have access to, before an General Election. From what I understand, Government department accounts that are published are always lagging behind and would not include some amounts which are classified as 'commercially sensitive'.  Therefore opposition parties and Parliamentrary select committees would not have access to accounts which contain real time up to date information. If a new Government have found £20 billion of spending liabilities they did not know about, this could be true, as £20 billion is not that much when you look at total Government expenditure. Government department are making decisions on spending all of the time and it could be the previous Government were planning tax changes and/or spending cuts to balance the books.  Jeremy Hunt has recently said that if the Tories had stayed in Government and held an Autumn budget, it would have been very difficult to cut taxes as some had wanted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanks Martin, have found Barclays forum following your instructions.

Re the Data Prot.Act letter, I notice there is a bit on there which says send correspondence to the address that you always have done, or words to that effect. However, I have changed address without notifying the bank. Guess I cannot send this letter without informing Bank of my current address? Means I will have to go into a branch as I don't have a pin for telephone banking.

No the best thing to do is send them copy proof of name and address.

This is the one you are at now,with a note saying you were at ........but are now at .........

Easy to do just a little customising of the letter thats all.

Just a quick question, am i right in assuming that 'bank charges' also include the fees they charge you for going over your overdraft limit?

 

Just about to start a case against Barclays so figured i should just reconfirm this, as the postings all talk about charges for returning DDs etc.

I have a single and a joint account which I wish to take Barclays to task with. Does anyone recommend that I present each seperately or shall I just chuck them both in at the same time? Also, if I do both together, should I enclose cheque for £20 with subject access request letter or should it still be £10?

Hope someone out there can advise.

Received statements today. Calculate Barclays have charged me £1910 for unauth o/d's, paid referrals, unpaids out and one stopped cheque! Shall I claim for the stopped cheque? £10 does seem a bit steep for stopping a cheque!

Sent prelim letter 9 Oct and received reply from Mike Brophy, Head of Customer Relations dated 12 Oct "sorry you are unhappy with the charges.....we do aim to find a solution within four weeks............full report or update will be sent to you within eight weeks"

They received letter on 10 Oct so I think it's time for the LBA. Template letter starts "... you have failed to respond to my letter...". Guess I just amend to suit?

Reply from Barclays offering £500.00. Tempting. But not that tempting. Its been so long I'd better start reading some more threads! Little me now offers the mighty Barclays Bank outside...... It's court next.........

Wait until you receive the Notice of Acknowledgement from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

 

Have received a Notice Of Issue from Northampton County Court which states that..." the court sent the claim to the defendant by first class post on 30 November and it will deemed to be served on the 5th December 2006. The defendant has until the 19th December 2006 to reply"

Is trhis the same as a Notice Of Acknowledgment mentioned by Michael, above? If so, I need to find the address of the banks solicitors. Should I just send to Churchill Place marked for the attn of the Legal Dept?

Received Notice that Acknowledgement Service has been filed today. It is dated 19th December 2006. Quote "The defendant now has 28 days from the date of service of the claim form to file a defence."

 

Adrian Ruffhead has signed as the defendant (well he's crossed the box).

 

He is stated as being the legal executive of Barclays Bank. He has also crossed the box which says "I intend to defend all of this claim".

Am sending schedule of charges to Mr Ruffhead registered post tomorrow. How will I know that Barclays has filed a defence, and would I be right in thinking that the 28 days since service of the claim would be around 2nd Jan? Thank you to anyone who may be following my thread and could advise.

When Barclays Bank files a defence, the court will then automatically send you an Allocation Questionnaire (AQ) to complete. Another copy will be sent to the Bank as well. 28 days starts from the date (5th Dec) the defendant is deemed to have received your initial claim and I think 2nd Jan is correct. Barclays Bank is known for delays. They wait to the last minute before responding to the defence. If they do not respond to the claim by 2nd Jan, if I were you, I would progress to Judgment by default.

How would I progress to Judgment by default?

Barclays have stated their intention to file a defence but I have not received an AQ, and if my calculations are correct, their time has run out!

Would I go into MCOL and request Judgment?

MCOL advise that I cannot take things any further online, yet there is a column headed judgment.:confused: elp
