      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all I am new to this forum.

I recently received 2 letters from a DCA called Mackenzie Hall basically stating I owe money from an original creditor Credit acceptance corp UK Ltd for £3500, no information when, why etc.

I have no recollection of this debt at all?

What type of letter should I send asking for information regarding this alledged debt?

Advice gratefully received...

sounds like a phishing trip

 

time yo ignore them till they play their cards.

 

dont forget dca's have no legal powers anyhow to do nowt

 

also check your CRA file just in case

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thanks, my most recent credit file approx a month ago is clean, no debts defaults or CCJ`s and I have this month obtained a mortgage so my file should be half decent. it does show these Mackenzie Hall as doing a search. Over 12 months ago I had a stat barred default removed from my file as it had been on for 6 years but is as I say no longer there now.

Ok,

Here is the latest correspondance from Mackenzie Hall:

I recieved a letter and the letter states..."you have failed to respond", it also says they obtained my address from a finincial link from a previous abode.

Apparantely they have been instructed by a their client Credit Acceptance Corp UK Ltd to recover £3259.93 of which as I previously said have no recollection of, they dont give any dates or mention what its for?

Oh and I have a deadline of 3 days with the date in bold red ink!!!Before further action is taken.

 

Why wont they inform me what the alledged bloody debt is for? I most certainly am not wasting my time phoning them.

Have you checked your credit files to see if these fools have placed anything on their?

 

The only thing you need do is to inform the OFT&TS via http://www.direct.gov.uk/en/Dl1/Directories/UsefulContactsByCategory/Governmentcitizensandrightscontacts/DG_195948 and advice them that this circus outfit is communicating in an unclear manner, and just that they are being a general nuisance.

 

Ignore is the only option.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I checked my Equifax credit file this morning 27-09-11, and there are no defaults, no CCJ`s, everything is above board, still got the search by Mackenzie Hall.

But as I say both Cred files Equifax and Experian are up to date and have no issues on them...Mackenzie Hall still not telling me what this alledged debt is for etc?

Hi, I would complain to MH

formally and demand to know

what they are after, they are

well known to East Ayreshire

Trading Standard for their

''business'' methods.

Address the letter to Mr. Rob Sands

their compliance manager.

I received an email from East Ayershire Trading Standards, they asked me to contact Mackenzie Hall by post (recorded) or email.

I have already emailed MH asking for details of this alledged debt - But the reply was ...give us your name, address and date of birth!!

Why cant they simply tell me what the alledged debt is for?

Well they can wait and wait I am not contacting them again, the onus is on them to prove this alledged debt is mine.
