Their proposal to change Bank of England reserve rules is over-stated by at least £15bn, and the cost would likely fall on businesses and consumers, not banks. These two factors mean that Reform UK’s plans have a total unfunded cost of at least £38bn – about twice the unfunded cost of Liz Truss’ ill-fated 2022 “mini-budget”.
    • The finance company has a 50% stake (legal Owner) in the deal so I would certainly involve them. As for the outstanding £3635 bill thats owing to Mercedes in Croydon I wouldn't be in a rush to settle that just yet and keep it in abeyance as leverage.  Where are you at with Doves in Horsham ?

    • Ok thank you. That’s where we are getting confused, as we’re not sure where we stand legally. But we’re still unsure who we should be going to now, the dealer or the finance company? I’m assuming the evidence we have (the reports from Mercedes) showing that the fault was there when we purchased would be sufficient to prove this? To be honest we would prefer to send the car back completely as are now concerned more problems may arise.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You can have your mail redirected for up to two years. After that you need to make a decision whether to inform them of your new address, you have an obligation to do so and many people come on the forum stating that they have CCJ's on their file and didn't receieve the court papers because they had moved.

 

I wouldn't personally, but make sure you don't let your redirection lapse

My advice is given through personal experience and is given without prejudice

If you use Royal Mail's 'redirect' service, then the CRA's are automatically informed of your new address, and the DCA's will get your new address from the CRA's.

I can do yes, I found this nugget of info out last year when I was researching CRA's/DCA's and how they manage to track gone aways down, it is a newish practice RM use in the guise of ' Fraud prevention'!

 

I'll have to dig out the relevant bookmarks, but from poor memory, they auto update their records with 'redirects' twice daily, and this info is accessed by the CRA's.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Well I asked the Riyal Mail for Keepsafe initially - they said I can't have this because I'm moving.

 

Asked for re-direction, but can't have this yet because the property is a new build & not on their system yet.

 

So am unsure the way forward from here. We are moving out this weekend & new people moving in the following weekend!

Just had a quick look on their website & don't know if I will be able to use that service

, as Royal Mail say it is for if you are travelling

Moving house or changing business address? Choose Mail Redirection and get your mail forwarded to your new address

Travelling in the UK or abroad? Choose Poste Restante and arrange to pick up your mail from Post Office® branches in the UK and post offices in larger towns abroad

How Poste Restante works

  1. Apply in person at the Post Office® branch you’d like your post sent to
  2. Tell your friends, family and business contacts your Post Office® address (see below)
  3. They can start using your address straight away
  4. All mail should include a return address on the back of the envelope

You can use most UK Post Office® branches and even some of the major post offices in larger towns abroad – you’ll need to take your passport if you pick up your mail abroad.

 

Here is how Poste Restante addresses need to be written:

 

Your name

POST RESTANTE

Post Office name

Full address of the Post Office

Postcode of the Post Office

Country (if applicable)
