    • Ok i think we may have the issue, so its been just over 6 months since i was banned and when i defended the case and it should have been rescinded. I have just spoken to the courts, and they informed the DVLA that the ban should have been overturned. Now you need to reapply for your license when you have been banned, and they give a window of 45 days i believe after it has expired. The dates add up, what i think has happened is that my details have been removed from the system because i was banned for 6 months (when i shouldn't have been) and the additional days on top. If this is the case then i surely i can sue these idiots until the cows come home, i have been driving whilst banned (again when i shouldn't have been)  and this can affect my job, imagine i had been pulled over with my son in the car, they would have just arrested me and not listened to a word of my story.  
    • First thing to do is what the the DVLA website extract says - write to the Central Casework Group with full details of your licence, adding that you spoke to DVLA call centre xx/xx/xxxx and they told you they couldn't see the details either.  Get proof of posting. Are you in physical possession of your Driving Licence Photocard? And the card shows it is still current? If so include a photocopy of it when you write to DVLA. There's no reason for you to assume that the licence has been cancelled or that you have been banned. Just some IT problem at DVLA. I wouldn't go into all the stuff about your court case last year. There's no evidence that the current glitch in the DVLA system is anything to do with it and it will just muddy the waters.  Most comparision sites ask for your licence number. You can get quotes without the licence being checked but when you take up an insurer's quote they then check your licence number against the DVLA website to make sure it is valid and to check if any Points for motoring offences are recorded. If you are unable to access your licence details on DVLA then insurers won't be able to either so they will refuse to proceed and cancel their quote.

    • Thanks just looked at SARequest It wouldn’t make ebay have to say why they suspended me. all their email said was that it was related to buying activity. But under that bike buying activity there are about five different reasons why it could’ve been. But they haven’t specified which of these five reasons it was.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI i live i a block of flats owned by a housing association, over the last year my car has been damaged badly on several occassions, the police and HA have been notified but the HA refuse to do anything like install CCTV make enquiries etc etc they DO NOT have an owners liability sign in their car park! where do i stand for the cost of the repairs? i am on disability benefit and cannot afford to have 4 panels on my car replaced, resprayed etc or the additional depreciation of the car. I got a new car 3 months ago and the car i traded in was devalued by £2000 due to the damage and now my newer car has suffered the same fate............... any advice much appreciated!

ps the close is a cul de sac and only residents would be up their. on one occassion i heard the perpertrators do it then enter the main door to the block but because i didn't see them the HA refused to do anything. But if they refuse to install CCTV how am i supposed to get proof?

actually yes i do have to park their!!!! their is nowhere else and i'm disabled. It is obviously a tenant who is doing this but the HA are happy to do nothing about it? as they have no owners liability notice in the car park i feel they are at least partially responsible for the repairs due to their lax attitude towards crime on their property. They could easily install CCTV (which has been recommended by the police) but they choose not to? perhaps i wasn't clear this is NOT the 1st time this has happened and it is a covered car park so can't be seen from any windows so their is never going to be any eye witnesses to see them do it?

I don't think you will get much joy with the ha I'm afraid. They do not have to provide CCTV, and will probably say they cannot afford it due to a rise in costs for everything.

 

Have you spoken to the ha about maybe re-housing you as you say this has happened a few times, so sounds to me like you are being targeted if other cars are parked there and remain damage free? I know you probably don't wan to move, and why should you? But it could save you the cost of insurance claim after insurance claim. We had to claim on our insurance due to vandalism a few years ago resulting in sky high premiums until it comes off after 5 years. I know how bad it must also feel going to sleep at night (or lack of it) wondering if your going to wake to furthar damage.

 

Having police reports of the damage may help you get furthar up the moving list, and getting your local mp on your side will also help them sit up and listen.

 

I know just how awful being on the receiving end of damage can be, stressful to say the least! So for the sake of your health it may be worth considering a move.

They will never accept liability. Unless they have described it as secure or monitored parking ( even then I am sure they would not accept it, especially as you know there is a problem )

Anymore than if you were personally attacked in the car park.
