    • We initially raised a complaint with the finance company who told us that as its over 6 months the consumer rights act won’t apply and we would need to provide evidence of the problem being there at purchase. As we have only just got the report from Mercedes we haven’t been able to submit this within their 14 day timeframe. Is this not the case then? Thanks

    • We purchased our Mercedes in September 2023 from Doves in Horsham for £21000, paying half cash and half on finance. We also purchased warranty for life via Ramp as recommended by Doves. On 12th May 2024 the car failed to recognise the key and wouldn’t not open, the AA could not identify the problem so via our warranty the car was taken to Mercedes in Croydon. After 3 weeks the problem was finally identified as water ingress in the drivers side footwell which has corroded and blown various components. After further investigation it was discovered the windscreen was date stamped 2019 (all the windows are 2018 - therefore not the factory fitted windscreen) The leak has developed due to incorrect sealant being used assuming when this was replaced and also water leaking from the seam. The warranty company do not cover water ingress so we are now faced with a bill of £3635. As we are now at 8 months since purchase (problem started at just over 7 months) we are not covered by the consumer rights acts. Would we be covered Sale of Goods Act? We have all the reports for the works being completed but unsure if this should be taken to the finance company or Doves who we purchased the car from. Do we pay for the works and then try and claim it back or should they be paying? Any help would be much appreciated

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am writing to you regarding recent telephone calls and letters received from your company and to complain in the strongest possible terms about the content of these.

I do not acknowledge any debt to your company and am not aware of having any contractual arrangements with yourselves.

On (Date) I received a phone call from an HFO agent and was extremely distressed by this call. I informed the agent that I was not aware of owing any money to HFO to which the response received included threats regarding access to my information and actions by bailiffs.

I have since received two letters from HFO dated (date) and (date). I consider the tone of these letters to be threatening also. The letters insinuate that legal action will be enforced against me even though your company has not obtained any legal judgement against myself and have not explained the cause of action.

I am familiar with the process of the legal system in England and Wales and your claims and descriptions of what will happen to me appear to totally misrepresent this process. Any legal action instigated by your company will be vigorously defended.

I wrote to you on (date) requesting that (do not know the content of your letter) but so far have not received a response to my correspondence. This letter was sent by recorded delivery.

I do not expect to receive any more phone calls from your company and request that all communication is in writing only.

I require you to send me a copy of your Complaints Procedure and expect you to respond to my complaint within the time limit specified in this.

This matter has been reported to OFT, FOS and Trading Standards. Any unauthorised attempts to access my personal data will also be reported to the Information Commissioners Office.

Today I received an letter from the OFT along with a formal complaint form for me to fill in. They've completed most of the info and also provided a different address for HFO along with a different name.

 

The OFT also stated that they have sent a letter to HFO outlining my complaint and have also requested that they send the required paperwork to me to prove I owe this amount.

 

Hopefully I'll get some form of response from HFO.

TR run the whole sorry mess. Head player is Alistair Turnbull, known affectionately as 'Alice'. If you look at the postmarks on any letters from HFO, they are all SW19. The West Byfleet address is just an accommodation address, actually it is the office of Roxburghe Debt collectors also under review. All calls come from the call centre in India.

Got a response from HFO re my complaint letter. Looks like they received the OFT letter too. Here's what it states....

 

Dear Miss ......

 

RE:Complaint - Threatening court action and not responding to proof of debt - (ref number entered)

 

I acknowledge safe receipt of the letter we received from the Financial Ombudsman Services on the 9th June 2011 and note the contents.

 

With regards to your complaint I will investigate and advised you of my finding, in the meantime the account is now on hold. Please find attached the company complaints procedure.

 

Should you wish to discuss the matter firther then please do not hesitate to contact myself on the above number quoting (ref number again)

So they'll acknowledge their letter but not mine? Even though I have proof of posting! Beggars belief really. Now that the FOS are involved maybe they'll leave me alone. I have asked for proof of the debt and the CCA along with any payment history from my account. Not received anything. I may just print all these letters I've sent and send them again but to her.

 

Any suggestions or should I just leave it?

Bloody hell! That was from HFO, someone has rattled their cage! can someone PLEASE post up there complaints procedure, I have been asking for it for a year!

 

They will leave you alone as the 'account is on hold' - if they do not, they are in real trouble. Let us just see what their response to you complaint is. Does the complaints procedure say how long they have given themselves to reply?? they should cover all the issues you have raised, cannot wait!
