Natwest have put a default notice on CRAs without ..as far as I am aware of following the correct procedure... i.e, default notice, deadline to pay, notice of affect on credit etc.

A letter was sent several months ago to ask what was happening with the account but got reply that either answered questions that weren't asked or were resolved already!!

They are dragging their heels over replies and this is causing financial problems.. getting loans etc that are needed and would have been obtained I am sure if this default wasn't listed... they withdrew a small (and I mean small) overdraft facility when the account was overdrawn within this limit without notification or letter to correct before reporting it to the CRA

What I need to know is what are the steps to be taken now... FOS is a waste of space as this is causing immediate problems and they will drag their heels I am sure.. what can be done to force the issue? Can court procedure commence now, if so, at least the wheels can be put in motion?

I would appreciate help on this :)

 

And how many CRAs do I have to contact regarding this problem?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

what i am saying is this a late payment marker or non payment?

 

whats the payment history show?

 

if you are supoosed to have been paying this off over the last few months, if you get 6 monthly markers, the CRA system automatically marks it '8' - defaulted.

It shows as default with one red block compared to the other account which have many green blocks.

This was an overdraft and within the original limit (the amount of the default is still within the original overdraft amount), they withdrew it without notification or default notice or notice to submit to CRAs

How many CRAs are there? Do I have to contact them all/join them all to correct this?

Hi, If you have been refused credit, then you should ask the lender which credit reference agency was consulted and whether the credit reference agency's information was the reason for the decision. You can contact this agency and ask for a copy of your credit file under the Data Protection Act 1998. This costs £2.00 by letter or over the internet and £2.50 by telephone. They will require your full name, signature, current address, date of birth and any previous addresses that you have lived at for the past 6 years. Your file should be sent to you within 7 working days. If the information is incorrect then you have a right to ask the agency to remove or correct the information

Thank you I will contact the other CRAs as well.

 

I contacted Natwest with some questions and also if they had notified any CRA at the end of November 2010. They replied to my letter but completely ignored my concerns about notifying CRAs and didn't answer that question at all. I have since sent them another letter asking them again about CRA and that they should not have notified them if they didn't follow the correct procedure
