      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:eek: Is that with Experian? Well thanks for letting me know! as my free trial with them is about due to end, and I was thinking of running at as it "seemed" to only cost £4.99 per month.

 

If this is the case then I shall cancel it. What are they like! They are worse than the flippin banks :mad:

 

You can see your report as many times as you like for £4.99 per month but to get the score it is an extra £4.99 each time.

well the AQ has been with the court for a week now as has the letter to the legal team at vodafone... no news as yet.

 

does anyone know the typical turnaround time for an AQ and when I'm likely to hear about the allocated track?

 

My understanding is that they get 14 days to issue their AQ, if they don't then the court send them an "Unless Order" giving them another 7 days to issue. If they don't issue it after the 7 days then you can apply for judgment!

Dayglo I wish my courts were like that!!

 

I quote "we cant find your file" hour later I phoned back "oh yes your file was in a box"

 

This was after the transferred my case in error to manchester then claimed Manchester had transferred the case to them in error, Gawd knows what would have happened if I hadnt had phoned them I think a) it would have been archieved with the box or B) transferred back to manchester!!

 

HA HA - Courts dont yah just love them!!

Huney - I was told by my court that the judge is only there two days per week, I guess thats cause Jones the Judge is Jones the Baker on Monday and Jones the Butcher on Wednesday and Jones the Preacher on Sunday!!!!

 

I think he probably Jones the farmer the other days of the week!!

Very interesting - as back in summer I had 4 unsatisfied CCJ's - 8 defaults and credit score of 565 - I now have 1 default over 3 years old - and my credit score is 335 - no missed payments for 4 years on anything. Only diff is now I am claiming banl charges - and have compalined/questioned CRA practices.

And my mortgage has reduced by £20k. I was talking to someone else who has been claiming bank charges and their score dropped overnight by 200 as well.

Some sort of bank secret code?

 

Oh my GOD, it would seem they are tracking these things and this needs clearing up, how do we find out who what and were these secret records are kept and have them stoped, this is a disgrace.......

For this you'll need to find someone who's credit record was sparkling before they claimed their charges and then went down afterwards. They then need to write to the CRA's and ask them for an explanation.

Still fishy though - I have a friend who reclaimed and their credit score dropped 200 points. But I thought lenders have their own criteria anyway.

They do, but that criteria is based, at least in part, on the scores and info from CRA's.

further investigation has revealed the following :-

 

Checkmyfile base their scores on reports from Experian/Equifax/Mycallcredit

 

They can't access account information from Experian so itgnores that element from the score. (you will see an inflated unrealistic score from Experian)

The Checkmyfile monthly updates are not very good at keeping up with the updates from the CRAs - all 3 reports for 3 months on my checkmyfile account haven't changed. There's a report reference number on each one. That's why the scores have stayed exactly the same for three months.

On Experian's on Creditscore system - I have claimed bank charges back and, as you know, removed 2 defaults and other adverse data. My score with Experian has increased by about 150 points in two months.

In that two months I have opened another credit account which I use to rebuild credit score (Vanquis credit card - very little usage, always pay bill in full at month end) - this apparantly makes a big difference to credit score.

I don't know what the situation is with Equifax and mycallcredit yet.

As Im in the middle of court action with a hearing next week Im going to hold off getting my info!!

 

Was informed yesturday that the Mortgage company has refused my application despite the CCJ being in dispute!!

 

Told them If I get it removed next week I will send them court papers as to filter down to the CRA will take around 6-8 weeks. And I cant delay the Mortgage that long.

 

They refused the court papers and said they will only consider it "set aside" when it comes off the CRA files!!!!!!

 

So am I to beleive here that the CRA are more powerful than the courts?

 

This has got to stop!!!

Hi Allyxia.

Totally agree with what you are saying there. All the financial institutions in conjuction with the CRAs are working as a cartelle and somehow this needs breaking.

If you listen to there responce to the OFT ruling on credit card charges

Now what they are saying is we and the CRAs are more powerfull than the laws of the land.

And they are just slapped on regardless of circumstances or amounts.
