    • I think we normally recommend people to follow the upload link
    • I removed them as they have my email address on them, and so shall repost them once my Snagit scrolling capture thing starts working (needs reinstalling I think as it keeps falling over); they are an email that runs over two pages, so would be best suited to a scrolling capture. As for multi page formats, this is harder as I have no tools available to merge documents, unless you can suggest any free ones that will perform offline merges without watermarking
    • Oh that is very helpful, thanks a million for answering my query. Looking at the license right now. At the front it says the issue date is 2022 (that's when I swapped it), but at the back it says 2015 next to Category B. So, I'm definately at 12 points, right?
    • The two PDF documents that you posted earlier are unavailable. I don't know why but maybe they are corrupt. I have deleted them Please will you post up again. Also please can you post multiple PDF documents in a single file multipage format, correct order right way round et cetera. Thank you
    • The New Drivers Act sees a driver's licence revoked if he accrues six points within two years of becoming a qualified driver. If you passed your test in an EU country, then that is the date you became a "qualified driver" for the purposes of that Act.  For drivers who became qualified more than two years previously, if they accrue twelve or more points within a three year period they face a mandatory six month disqualification unless they can persuade the court that they or others will face "exceptional hardship" if they are banned.  In both cases, the dates of the offences are used to calculate the relevant period.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry night-watchman,I was only joking about my Daughter, she can be very firm but not abusive.

I actually took the very good advice of ploddertom - I emailed my local councillor yesterday outlining the whole story from when my Grandaughter split with her partner.

She emailed me back this morning and was very sympathetic, she has arranged to meet my Grandaughter at the council offices tom orrow and speak to them on her behalf. She has also forwarded my email to the Chief Executive of the council so hopefully this will be resolved tomorrow.

Thank you ploddertom, this definitely seems the right way to go.I will come back and let you know how we get on.

No problems Wendy :) it was just another case of how low they will stoop to get their own way.

I am pleased to see that things are on the move for your g/daughter and wish you both luck in resolving this issue.

Please keep us up to date.

True to her word my local councillor turned up today and tooke her turn in the queue to speak to an advisor who insisted that My Grandaughter would sill have to deal with the bailiff.

At this my councillor, bless her, took the phone on the advisor's desk and called the CEO who came down immediately.

When we showed her the documents and explained the situation she was furious at the way my Grandaughter had been treated and within a matter of minutes she had arranged for the debt to be recalled from the bailiff and, exactly as I had been advised on this site, she said that she would apply for an attachment to benefits of £3.00 per week.

She also took the letter that the bailiff had put through my Grandaughter's door and said that she would be contacting the Director of Rundles regarding their actions, she was not at all happy with them.

I have just returned home to find an email from the CEO giving me all of the information of her actions, recovery has now ceased and My Grandaughter can settle down again, thank you all once again.

All in all, thanks to the good people here this has now been resolved

That is really good news, I am very happy it has been resolved.

It just goes to show that even if some people who are classed as vulnerable will stand up and fight against these intimidating bullies.

Once again well done ..... a great result.

A great result particularly coming on a Friday. Not trying to be funny but a suggestion either to your Councillor or Chief Exec - ask them to revisit staff training on these type of matters, would think if the Council actually checked out their customers status prior to taking action most of this could have been avoided. Hope you & your granddaughter can have a peaceful future now.

Thanks for your replies,I am feeling very pleased with myself and even more so with my local councillor.

My councillor did comment on the abrupt way that even she was dealt with by the benefits advisor,it was only when she phoned the CEO that the attitude seemed to change,it was quite funny actually, watching her cringe as the CEO appeared.

Seriously though,I would advise anyone with a problem with Rundles to seek out your local councillor to tackle the council, mine certainly made them sit up and listen.
