HI Everyone, New to this forum!

 

I had a contract phone with 3G way back in 2003/2004. They totally messed up my account and after many infuriating calls back and forth explaining the same thing over and over again, I thought things had been sorted out, and that I in fact owed no money to 3 any more.

 

Then, in 2009 (I had moved from my mothers house by this time), my mother started to receive some not so nice calls from HFO in regards to this 'debt' and wanting payment.

 

My mother told them that I no longer lived at the address, did not have my new address (which was true at the time) and told them to stop calling/ hassling her with the phone calls. HFO did their usual (as I have read from other posters) and called continuously, sometimes being quite threatening. Then when my mother threatened them with legal action,and told them that as far as she was aware, the 3 'debt' had been settled, all calls stopped.

 

I then had the embarrassment of having to go though a Debt Relief Order, due to being a single parent and getting into a lot of financial difficulty. So credit reports were needed, which meant that my new address was used to get this information. This supposed debt was not included, as obviously, I had no idea of it.

 

Suddenly I started getting letters from Roxburghe, in regards to HFO Capital Ltd with a total amount owing of : £383.34.

 

I told them that all this had been dealt with, with 3G back in 2005/2006.

 

They then went back to 3G (apparently), who told them that back in 2005 they had told me that I had been mistaken thinking that they had made a mistake with the bill and that the money was actually owed to them.

 

And now Roxburghe are asking me to provide detailed accounts on what I spend my money on each week, so they can see if I have anything left to pay them with!! (Which I do not!)

 

I am infuriated as, to my recollection, this supposed debt to 3G was sorted out back in 2004/2005. I did not receive anything from 3 afterwards asking for any money, as at that time I was working, earning a nice wage. So If I had received a bill from them I would have paid it and had it over and done with.

 

It just seems a bit odd that all of a sudden 4/5 years later someone is asking for this money - and not asking nicely either!!!

 

Can anyone help? I've looked at the letters that I can send asking for the original contract, but not sure if this can be done for phone contracts. Also not sure about if it goes over 6 years is it also the same as it is if it were a credit card (you know about them not being able to legally do anything about it?)

 

I'm stuck and getting rather upset by it all. I've got enough to worry about with putting food in my 3 year old's mouth, let alone some fat cat trying to get money that I am sure I do not owe.....

That's what I thought in regards to the statute barred. I do need to find out when I last made any kind of payment to 3 though, to check that it was over 6 years ago.

 

In regards to my DRO, as this debt was not put on the DRO when I applied, it can not be added to it, or so the good people at the Insolvency Service tell me.

 

Just wish I had known about it when I applied and was able to put it on the DRO - get rid of these monsters for good!!
