      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Judge Today Awarded The Return Of My Car !!!!!! And Asked For Us To Return To Provide Rest Of Case As Court Had Only Allocated 15 Mins For The Hearing By Mistake.

I want to check if the BOS has been registered properly so I phoned LBL and asked for the registration number from the BOS. They refused to give me it and asked if I had been reading CAG looking for an easy way out of the agreement. I told them that I was aware of CAG and other peoples problems and that is why I wanted to make sure everything had been done properly. He said that it had been done properly and was water tight. He then said that he would now personally monitor my account and at the 1st sign of any anomoly they would act!! (I guess that was a threat) Is there any other way I can check without the number if the BOS has been done correctly?

 

BTW I am fully aware that I have now just given myself away, but so what! So far I haven't defaulted in any way shape or form and I don't intend to!! However Mr LBL I have the full might of CAG standing behind me so if you want to play lets get at it!!! You also better prey that everything is water tight!!!!

I bought my vehicle from a private seller,I have a written recepit and was totally unaware of a loan fixed against it. Iv had mobilemoney trying to take my vehicle and Im wandering can they bill me if i dont give it to them?

He has to give it to you, you can force them by using a SAR.. they have 40 days to send you everything include phone transcripts, you suck on that Mr LBL man....If they fail to give you your everything on your account the fall fail of the Data Protection Act 1998, you can complain to the Data commisioner or take them to court yourself (usally faster).. theres more ways to skin a cat, or shoot fish in a barrell....LBL personel are TOOLS...

Hi plumber. because you are not the loan taker then they need a court order to remove the car from your property. even if they turn up with the police you still DO NOT give them the car. the police are only there to keep the peace.

 

yes they can bill you for the car. again only though the courts. and if they go that way then you dont need to pay anything for the court case.

Hi ims. get your car checked by your insurance company .... the rep company has to have insurance. dont do it yourself. and this is not being nasty to lbl but your car should be in the same condition returned as when taken. get your insurance to arrange getting new keys and the programming that needs to be done.

im so peed off at the moment, it is unreal, im calling my insurance company as we speak, i cant put on here how i really feel but the **** will defo hit the fan very very soon

insurance company said due to legal issues they are not allowed to relock the car or change the immobiliser codes, they said i may need a court order....mmmm. thinks i may be changing my insurance too.

 

Just spoke to a man with a dog, he said he could relock the entire car and reporgramme the immobiliser to match the 2 new keys he will supply (with the pug badge on each key as with the originals) for £200. he coming have a look in the am.

 

Suck them apples lbl, Anything you can do, i can do too

Just spoke to a man with a dog, he said he could relock the entire car and reporgramme the immobiliser to match the 2 new keys he will supply (with the pug badge on each key as with the originals) for £200. he coming have a look in the am.

no no no ims ..... another problem (also good for you) your insurance company are acting on the HPI info. (outstanding finance) i.e if you went out for the day in your car and you lost your keys you call your insurance and they arrange new ones.

 

you need to call your insurance again. also get them to call the court your case was in.

 

another problem that has now come out of this ... your insurance company has lbl listed as interest. if you have an accident tomorrow. it will be lbl who gets paid. i would leave your car as is till you go back to court.

You would think they would just say....hey enough is enough, lets not try pee this guy off anymore, he has a tank and we got sa bow and arrow, think this guy might just win, but they dont, they still think they have a chance OMG.

 

Reason i wanted all locks changed etc is they still hold the spare key, dont want to wake up one morning with the car gone AGAIN lol

yes OFT has a good file now lbl appeal date ends in march 2011. some how i dont think it will get that far. bill of sales will never go but at least the law will change on how they can be used.

Hi IMS, Listen buddy,Clear your head a second, you have you car back, you may find that they have broken the court injunction, the car is not in the same state as they had taken it-keep a record of how many days you lossed the use of the car... Now the marker (HPI), did you raise this with the judge at the trail? If not when you contact the court, request that the case be put back infront of the Judge on this matter and the car...

 

Hit LBL where it hurts, publicity...

its hard to keep a clear head when you are dealing with this kind of company, i have contacted the courts today and again tried the insurance company, they ins company clearly stated that the onus is on lbl to pay for the new keys to be activated, as it is thier fault they dont work anymore, so i have now been without my car for 2 months.
