hello all

 

i have ignored all letters from debt collecters aking for payments from debts during last 7 years

 

i recently just read about statute barred debts , does this only apply when companies havnt contacted me for 6 years or can i still use this statute because i havnt paid any money or acknowledged the debt.

 

Hope that makes sense

Hello and Welcome, Ged.

 

If you have not acknowledged the debt in a period of 6 years (5 in Scotland), then yes the debt will be Statute Barred.

 

A normal debt becomes Statute barred after six years (five in Scotland) however a CCJ never becomes Statute Barred although after six years the creditor would have to seek permission from the court to enforce it & that is rarely if ever given.

 

The easiest thing to do first is check whether there's a CCJ against you, if there is you can apply to have it set aside, if there isn't it will be Statute Barred.

just to add recently i made a agreement with one company to a repayment plan, but it was after 6 years and i havnt paid anything yet can i still use this statue on that one or am stuck with that now i have called them

Yes, once a debt decomes Statute Barred, there's nothing to un-bar it.

 

If your sure a debt is Statute Barred, once you write to whoever is chasing you, to tell them this, that should be the end of the matter.

 

They can persue you for it, but only until you tell them it's Stat Barred.

can any one help if possible,i have been recieving letters from lowell ,i took out a credit agreement with lloyds tsb on the 4/06/1992,i have never replyed to these letters,what should i do?

its statute barred.

hello all, i have sent two letters recorded delivery, standard ones from the internet, i have heard nothing since, even though i have asked for confirmation that matter is closed should i leave it, or should i chase for confirmation

Leave it - they know full well the debt is statute barred, they just work on the assumption that you don't know your rights and will pay up.

 

Unfortunately for them you and lots of others found CAG :)

I know this forum is great massive weight off my mind will make a donation to site, reading threads the things people do for free for others is great. the Site should be funded by the government as its a public service in my opinon :)
