    • I did what I told my husband not to do…and I telephoned them. All credit where it’s due, the lady on the phone was very helpful. I’m not gonna lie I broke down on the phone as this has been incredibly stressful. Perhaps that helped, but I would like to think they just realised they sold us a faulty car.    so we only bought one extended warranty and that was with Nissan. The car salesman gave us the hard sell and we fell for 100%! Part of the sell was if there was ever a problem then we would only ever take the car to a Nissan garage. There was a problem after a few days and we were instructed to go to a third party grange! We contacted Nissan on the phone and they said they would put on a complaint for us so maybe that helped too.    we just want to try and get all of our spend back now. The deposit, money for the finance and money for the extended warranty. I reload we will probably have to pay costs but I guess we can’t argue with that. We just need a new car!!!! Aaarrgghhhh!    thanks so much for your help once again.
    • Right I see I didn't realise it had to be laid out like that. I have had another go, sorry I'm really struggling here! 1.The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. The claimant has thus far been unable to produce any evidence that the alleged debt has been legally assigned to them. Nor have they been able to provide evidence that notice of assignment was given to the defendant on the dates stated in the particulars of their claim. 3. The claimant has given no details as to the breakdown of their claim or what dates it relates to. As a result the defendant is unable to specifically defend the claim until the claimant can show how the amount has been reached. In the claimants particulars of claim, the claimant openly admits that they have a copy of the agreement and its terms and conditions but have failed to provide these to the defendant. Pursuant to the civil procedure rules Practice Direction 16 (7.3) Where a claim is based upon a  written agreement: (1) a copy of the contract or documents constituting the agreement should be attached to or served with the particulars of claim and the original(s)  should be available at  the hearing. With the court’s permission the Claimant is put to strict proof to:- a) show and disclose how the Defendant has entered into an agreement; b) show and disclose how the Claimant has reached the amount claimed ; c) show how the Claimant has the legal right, either under statute or equity to issue a claim; 4. As per Civil Procedure Rule 16.5 (4) it is expected that the Claimant prove the allegation that the money is owed. 5. It is therefore denied that the defendant is indebted to the claimant as alleged or at all.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My 18 year old son has just been told by a colleague that he will be losing his job. This was his first full time job as such but he gave up working shifts at a local cinema for it...

Without going in to the ins and outs, what rights if any does my Son have and when should he expect payment if sacked/made redundant.

He only started the job on the 5th April so I know he isnt entltled to much if anything but it just feels like hes been shafted as he has helped get the store up and running and has gone out of his way to help with various things.

I just want him to go in prepared when he is told officially.

Thanks in advance.

As you have rightly gathered, with less than a year's employment he doesn't have much in the way of employment rights.

I can't agree, mariefab.

I think it is every employer's worry to make sure that all employees are being given contracts, relevant training, workwear etc.

As said by every lawyer in employment, every case in employment would be different and you would have to take an individual look at it. We, future psychologists, would say exactly the same about a person's life story - you can't treat all of them all the same, all the time...

Hi ms smith, hope you're well. I think mariefab was trying to say that UK law has set down legal entitlements, procedures etc, that govern this sort of thing. We may not agree with how it's being done, but this is how it is in disputes within the rules.

Once you're running the world ms s, I'm sure it will be much better. :)

Hi, yeah I am fine. Deadline for bundle runs out end of next week so I am writing, writing, writing... :)

Have to go through it all again, but hopefully last time...

As for UK law - I think I am overally happy with it (at least I feel more protected than in Poland), if I don't like something, I believe there is a way to put through your arguments and clap it with as many examples as possible. It all should work towards greater good anyway, isn't it?

Guess what? I already wrote, anonymously, a petition to Polish officials, a few years ago, from UK, saying that I will write to ECJ (European Court of Justice) if they will continue with unfair treatment to some passengers of national rail in PL. Guess what? They made some significant changes! But - they cancelled those changes after I published my letter on a public forum and they probably traced it through my nickname and read counter-arguments that internet users were posting... Anyway, I had fun as I was on holiday in PL next day... Imagine :), I am having a cup of coffee at my parents' home, working on a skirt (I sew some clothes myself... :)) and then there's an info in the radio that national rail has cancelled a controversial, brought to life a few years earlier train connection... A few days passed on, they brought it back. Even the journalists were wondering why such sudden big, illogical changes...

I didn't do it, man!

Of course not telling everything to mummy. She would take me for a lunatic :)

or died instantly...

Sorry for offtopic...

Thanks for all the kind words. Im sure the boy will do good. He has a great work ethic and is a genuinely nice kid, polite and all!

Yesterday, he and his father went to look at a flat for sale as he is already thinking ahead and wanting to get his foot on the property ladder. Just glad he hadnt signed any of the paperwork and then found this out!

Turns out his old place of work have been saying they really miss him and would love to have him back, give him additional training and responsibilities, which in turn means more money!
