Letter says we have been asked to recover from you on behalf f our client in Middle East x amount. if you believe you are not liable please contact us - yeah right! If you wish to make payment here are our client bank details which look genuine and relate directly to a Dubai bank. ” if you don’t engage our client may take further action” etc blah blah blah. its the same type phrases used by CWD/IDRWW/IDR etc…..   I ignored the email, blocked the text number and will wait to see if I receive any formal action via Mail but seems like the same tactic I’ve seen for 10 years plus and I’ve ignored all. just for people’s info

    • Visiting scotland I came across a car park at The Falls of Shin operated by Civil Enforcement Limited. The car park requires visitors to pay using the awful Phone and Pay app or over the phone using an eqully terrible automated service. Their signs state a time limit of 10 minutes after arriving to pay, and both methods require needlessly lengthy registration process only for payment to be rejected when attempting to pay by both. The Cafe were able to offer us some assistance and register our vehicle so hopefully we sould avoid a fine but this seems like entrapment and would still stop us returning again. How is this legal without giving visitors the option to pay on site?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have made a payment that I was bullied into and they tried to bully me into setting up a direct debit there and then on the phone. I made the first payment before I did my research or else they would not have had a single penny from me.

she was very eager for me to hand over my card details but I said no and nor was I leaving it in a gas box for any Tom Dick or Harry to take and have no proof that it had been paid. I may owe the bank the money but they are in no way proffesional and I felt I was trying to be conned! Yeh good for you ring bank up and cancel it or they probably will take money from you. She didn't deny on phone when I said ud probably take whatever from my account so no way am i doing this!

Companies like Moorcroft just make their money out of scaring people and hoping that they wouldn't do a bit of investigating. The woman I spoke to on the phone got very nasty with me when I said I would speak to a debt management adviser or even a solicitor myself.

Yeh I bet she did. Well if I hadnt have found the info I had on this site I really would have been none the wiser and would have stressed and stressed what to do as after speaking with them 4 times on phone and having him at door I would have been reluctant to give them anything but wouldnt have known that I could challenge it

Nor could I when I hadn't had any letters to this address. I have been here a year so if they can send a bloke out surely they can send a letter!

And to not leave after I asked him two atleast 4 times was ridiculous

Hard to control your temper in that situation!! But at least you know that you are not alone.

 

I don't think that these companies that you take credit out with banks, argos, etc should be allowed to sell your debt or pass on your debt to these sharks.

Well mine has been the same. Royal Mail actually told me when I rang yesterday that they were still processing my letter. When infact today I have had a letter dated the 20th of May (I posted mine the 13th) from Moorcroft saying they don't have my CCA but will ask for a copy from the actual lender. So the chances are your letter has been recieved by them and its Royal Mail who aren't being efficient with their tracking system.

its the only time ive sent recorded items that havent shown up they have got there as I have posted two CCA requests to diff places and neither have said they are delivered, still awaiting reply from the 2nd one but if its like the first they may have received it and its Royal Mail who haven't updated their info

Tell RM you want a refund for the recorded delivery charge. Normally gets results..

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I have today recieved a letter from Moorcroft in response to mine. My scanner isn't working but I will type it in for you to have a read.

We refer to your recently recieved letter requesting data as per 77-79 Consumer Credit Act 1974.

 

We duly confirm that we have requested the relevant documentation from our client and once we have recieved we will forward the same to you. Meanwhile, we duly confirm that all collection activity on the account has been put on hold and we will not seek to enforce any payment of this debt until such time as documentation has been supplied or we have advised you to the contrary.

 

In the meantime, however, we believe that it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior any possiable court action or further investiagtion. To this end, can you provide an indication of the information you are relying upon, when giving evidence to the court or information to the relevant authorities in relaltion to the alleged subject matter of this account.

 

Please could you provide this information by return as this will ensure that all possiable areas of dispute are identified as quickly as possiable therby minimizing potential costs and delays.

laalinz I got the same letter in light of that I am assuming they don't have the CCA so will await to hear from them again as I haven't had anything since. They said same that they were requesting mine from actual lender we will see?
