    • I purchased the vehicle using finance through motonovo under a HP 60 months agreement. I have now amended the document ensuring all is in black. Unfortunately, this email has now been sent. However, I have not sent a letter to big motoring world. Also, I have taken the section of the firealarm issue. I am struggling to convert to PDF. I am not tech savy at all. My mistake was that the the salesman was very fussy on a sale. We went down a quiet road for a little test drive and not for a lengthy road test. The water issue was not present at this moment of time. However, it only became prevalent after driving away, after all docs signed. I did stated to Audi I wanted a diagnostic report. However, they carried out an Audicam which is footage of the issue. Audi have diagnosed the issue as a common issue where coupes/cabriolets accumulate water in the seals. However, I did state beforehand for no issue to be rectified due to me wanting to reject the vehicle. I am awaiting a report from Audi through email from the branch manager in relation to the issue. The issue so far is the water still being present in the sills. Audi tried to fix the issue however the problem is still prevalent. Regards

    • Right,  so the court hasn't send out the Directions Questionnaires/N180s yet. PE's one is a false one, meant to intimidate you into thinking your defence was rubbish and they are confident with their claim. This is par for the course.  The PPCs do this regularly. However, PE have gone further and written that "a copy has also been filed with the court" which is a lie as the court haven't even sent out the papers yet. Keep a screenshot of MCOL, later on in your WS you can draw attention to their lying and abuse of court procedure. If you've got time on your hands, then complain to the BPA about one of their members lying.    
    • We need documents to be uploaded in PDF format. Uploading in Microsoft Word format discloses personal details relating to you which you should not be sharing. Click upload – to understand what to do. How did you pay for the vehicle? You start by saying that you should have walked away – yes you should. Not only because of the reputation of this company but also if the transaction isn't perfect you shouldn't get involved and you certainly shouldn't be taking the word of some used car dealer. Big fail! Why are some of your letter in black and some the in red? When you get some of the ideas in there – have you use a template from somewhere else? They aren't interested in a delay caused by some fire alarm or something. They certainly aren't interested either by the distress you are suffering. They have hundreds of customers who become victims of this kind of thing. All of those customers suffer distress. Big Motoring World don't seem to be very bothered. What are the faults which exist with the vehicle now? Is it just the splashing? Where is the splashing? What is it that is splashing?   Do I also understand that you purchased the vehicle without trying it at all and the first time you were in it and had splashing was after you had made the contract?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, new to this site. I'm relly stressed out because two days ago I was called into the jobcentre on the premise of a 'review'. I was taken into a room and it turns out some idiot has reported me for working whilst claming benefits. (I WISH I had a job lol). I do voluntary work regularly, which I have declared to the jobcentre, so thats not a problem.

 

Anyway, I wasnt really told what would happen next, just that I 'may' have surveillance on me, but im guessing they have already watched me, because they have tipped me off now if I WAS working. I have absolutely no clue who reported me. Not many people even know im on benefits. I live at home, so most people probably think my dad pays my way. Is there anything I can do, because this is obviously a false accusation? I'm not having people reporting me and getting away with it. I want to look this person in the eyes, in court if thats possible. My name is also foreign-sounding, so only someone I know would remember it to report me. Most people cant even say my name, nevermind spell it to report me.

 

Will going to the police help? I just want some closure. I keep getting upset about it. The irony of all this is I am 22 and havent even had my first job yet, how I wish I even had a job to lie about! Any info is appreciated.

They are not going to give you the name of the person even if they have it - remember even anonymous reports need to be looked into.

 

I don't think that you would be able to do anything like take it to Court or Police if you do find out the name. The Benefits Agency needs people to report possible Benefit fraud and all the person would have to say in Court is that it was an honest mistake.

 

Sadly, in life you come across people who will be malicious or will stab you in the back. It's hard when you don't know who it is as then you feel you don't know who to trust.

If I found out the person's name myself I wouldnt need the police anyway. I plan on dealing with the matter myself. They will think twice before they try and report me again, thats for sure. Yeh I feel myself thinking about all my friends in my head, and who could have done it. I just dont know. Some people I havent seen for months, and many dont know that I'm on benefits.

 

Im going to contact Citizen's Bureau, I may have to pop into their office though, they never answer their phones, all day long!

 

Anyway, called the Jobcentre customer compliance department today. They said its all over, but they still didnt tell me if I have been judged innocent. I was also told that it wasnt true that I would be watched, yet the lady at the interview clearly said to me I may be watched, and my bank account would be looked into. She denied all of it. I wish I had a lawyer with me! I then called the benefit fraud hotline, and they were no help either. I feel like I am guilty! I am just really stressed out and upset all the time, I need closure.

Sorry to say mate you will never know who did what and when, my advise is do your unpaid word declair it and move on don't let it get you down if you have nothing to hide just get on with your life and you might find a full time job.

How are you going to find out? If you accuse or take action against a person without concrete evidence (which let's face it unless the JobCentre give you their name or the person admits doing it you are not going to get) then does that not make you the same as the person who reported you. Someone who makes trouble for someone else without having all the facts/proof. Trying to narrow it down won't work as you may be surprised who knows you are on Benefits. People are often not good at keeping secrets and can let things slip to someone who then tells someone else and so on. People do like to gossip.

You don't seem to want people to know your business. By spreading rumours about them? - again if you did that you would be the same as them. Two wrongs don't make a right.

 

I know your angry but the best thing is just to get on with your life and if someone does admit to reporting you then have nothing more to do with them.

 

The JobCentre have told you it's over. They know that sometimes people are reported for Benefit fraud because the reporter doesn't have all the facts or they are just being malicious. However, what they will not do is basically say you are innocent of everything they'll just stop any investigation so don't worry that they have not said this.

 

In life we don't always get closure and you have to learn to live with this.

You clearly have not been working and the compliance team are taking things no further. Going to CAB will do nothing to help, its best now to walk away and forget this, some spiteful person may have wronged you but the department has to look into these accusations. You have nothing to gain now by fretting over this and hopefully you will find your first job.

If you keep going on about it then maybe someone will think you have something to hide, but you know this is not the case so let it be now.

Don't waste your time and energy stressing on this. The information was almost certainly given anonymously, but if it wasn't the DWP will not tell you who it was.

Move on, no point torturing yourself wondering who it was. Someone could have seen you sign on, and seen you go out to do voluntry work, put 2 and 2 together and got five.

Some unscrupulous people use the guise of voluntary work to do paid work. (work an hour unpaid then nip off and do 8 hours elsewhere paid and use the unpaid work for the reason they are unable to attend the prescribed time to sign on)

 

Take the time to thank the job centre staff for investigating the matter and proving that in your case this is not the case..........at the end of the day the person reported you for working whilst signing on this is as you state is correct you are working whilst signing on.

Stop wasting your time doing voluntary work and use the time to find a job, GO STUDY TO IMPROVE YOUR CHANCES OF FINDING A JOB...LET THE FOREIGNERS WHO INFEST THE EDUCATION SYSTEM DO THE VOLUNTARY WORK TO PAY US BACK....................................

 

You can hold your head high..........and even wave at the surveillance team.

 

The person who reported you will not have wanted to benefit from you being caught but to cause you the reaction you are currently giving them........

Im going through the same think but my accussation was that i have a partner living with me. unfortunatly my decision has come back as i have told a pack of lies at my interview, my benefits have stopped, rent & ct are full, childcare stopped while im a full time student! i can not beleive sum nasty twisted people out there who have nothing better to do. as a result in this im ready for blowing my top with certain folk on this road. there was no concrete evidence & i gave a really genuine reason why my ex was seen at my house 3 times in 8 weeks! i feel like a criminal when i honestly have done no wrong. at the moment im asking for the desion to be reviewed im taking this all the way but in the mean time i can not begin to say how much stress im under & how angry i feel. people who report people should be made to leave there details so they can be later asked to why they made these accusations. hope you get your wanted out come...it may be a long stress full process but hopefully in the end we will be proven innocant
