    • In my time I've never seen a payout/commission from a PPC to a landlord/MA. Normally the installation of all the cameras/payment of warden patrols etc is free but PPCs keep 100% of the ticket revenue. Not saying it doesn't happen mind. I've done some more digging on this: Remember, what your lease doesn't say is just as important as what it does say. If your lease doesn't mention a parking scheme/employment of a PPC/Paying PCNs etc you're under no legal obligation to play along to the PPC's or the MA's "Terms and conditions". I highly doubt your lease had a variation in place to bring in this permit system. Your lease will likely have a "quiet enjoyment" clause for your demised space and the common areas and having to fight a PPC/MA just to park would breach that. Your lease has supremacy of contract, but I do agree it's worth keeping cool and not parking there (and hence getting PCNs) for a couple months just so that the PPC doesn't get blinded by greed and go nuclear on you if you have 4 or 5 PCNs outstanding. At your next AGM, bring it up that the parking controls need to be removed and mention the legal reasons why. One reason is that under S37(5b) Landlord and Tenant Act 1987,  more than 75% of leaseholders and/or the landlord would have needed to agree, and less than 10% opposed, for the variation to take place. I highly doubt a ballot even happened before the PPC was bought in so OPS even being there is unlawful, breaching the terms of your lease. In this legal sense,  the communal vote of the "directors" of the freehold company would have counted for ONE vote of however many flats there are (leases/tenants) + 1 (landlord). It's going to be interesting to see where this goes.  
    • @Whyisitthisthank you very much for asking. I am still feeling anxious, especially when someone rings the doorbell, or when I receive a letter I feel a it paranoid. I stopped going to the shops unless I really have to. I shop online now. When I see security I feel paralised. 
    • My expectation was their WS would include the best paperwork, like at least true copies of originals, but these just look wrong somehow, perhaps the font and size of font... Not sending me the DN in CCA request but producing it for evidence I would argue could be a tactic used by them... - Page 11 with ticks - there is no reference to IP addresses - Home addresses are correct for dates in documents   Just looking up example Defendant WS's while awaiting your thoughts on this

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, here is a quick overview of my situation:

 

Back in 2004 I bought a house with my ex's mum as my ex could not get credit.

 

The relationship lasted around 2 and a bit years, in this time she bled me dry financially and resulted in me having over 100k of unsecured debt.

 

The relationship broke down back end of 2006 and I also lost my high paid job around the same time.

 

She moved out taking all my assets that she could - most of if not all the debt I had was to buy things for house or for her.

 

I did manage to sell the house before things got too bad and got pretty much nothing out of the sale due to the market etc...

 

I was forced to move back in with mum and due to having no money/job I did not pay any of my debts at all - they did have my new address though.

 

I did have one good bank account as it were with halifax and did keep on my car hp as I needed a car to get to interviews etc... the car finance was with inchcape who at the time i was unaware were connected with halifax.

 

Anyway....i didnt open up any post in this 2 years and i was in deep depression with a bit of a drinking problem but after a while i started to contact the collection agencies with offer of small payments etc and after a while all my old creditors were recieving some kind of payment.

 

The payments i am making will never pay off the debt in my lifetime as i will never earn the kind of money i was earning back then.

 

things were going "ok" in the sence that people were getting money up till recent when my income went down so as i was paying the collection agencies via standing orders i just reduced the payments.

 

as you can tell i am in a huge mess but there are a few key questions I want to ask:

 

Ok...i am kind of aware of the 6 year rule with defaults, i know everything defaulted on me as i got a copy of my credit report. I am paying the agencies every month but after the 6 years is up would my credit report be clean again?

 

what would be the best course of action with my debts? i know my post is a bit jumbled but so much has happend i just dont know what to do.

Dude I don't know too much, but you can look around the web for companies and if you get to a phone which is not your house (so you don't get call after call) then you can probably wipe off about 60% of your debt immediately, so to speak. Bankrupcy may be an option for you as the debt is so high...if you never expect to earn serious money and the thought of it all is crippling you then you would loose it all and be able to get basic bank account like Bank of Scotland take on anyone surprisingly! The main point I see here is you believeing the end will come...because it's actually the new beginning you are looking for isn't it ;~)

Basically hold your head up high and say man it wasn't me...there are so many ways out of financial crisis as ultimately it is only a man made thing...money is paper doesn;t really exsist so you can scrap it all and start again but you have to look at a frugle life for a few years...then if you want to burden yourself once more with betting on your fufture then go ahead...

All I say is that there are loads of ways out and they are all willing to help you, coz without you the world's economy is weaker...as you wouldn't be spending like you would if you were a confident person...

we are going to need to know what debts you have? are they credit cards, secured, unsecured loans, overdrafts etc. if we are going to be able to help you will have to let us know what they are..without revealing personal details..

I agree with D4G lets know what the debts are for and caggers can advise accordingly.

I would only consider Bankruptcy as a last resort so have a look at IVA's or Debtplans to get some knowledge of how they work.
