    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So now it is 3.30ish on the afternoon of the third day I have waited for a Sky engineer to call to install a new box and multi room.

 

The first install was due on the 30th October. After waiting in all day and having no contact from Sky I called to see where They were. He actually turned up around 5 pm.

He stood on the drive, took one look at the house and said " sorry but this needs a special heights team. Sky engineers will not do the install"

He went on to recommend I contact an independent installer and was kind enough to give me the name of "someone he knew":-o

 

Anyway after recovering from the shock of how completely unprofessional this muppet was I contacted Sky who told me he should not have told me that etc....... and they would re book the installation for the 9th Nov.

 

9th November waited in all day. No one called or contacted me at all from sky and I spent the best part of 3 hours making calls trying to sort it, with no joy.

I was told as a gesture of goodwill (Where have I heard that before?) they would credit my sky account with £10.00. ( still waiting) and re book the installation for 21st Nov (today).

The "Manager" who offered me the GOGW and booked the install gave me her "personal extension number" in case there were problems on the day of the install. I tried calling her and after 25 minutes on hold was told she does not work on Saturdays!!!!!:eek:

 

 

So there we have it. Sky have taken my money for the install and my first monthly payment for the new service neither of which I have had. They continually lie and fob me off with BS excuses and do nothing to try and compensate in any way!!

 

THEY ARE COMPLETE AND UTTER COWBOYS AND CON-MEN!!!

 

They have me signed up and are taking my money. Now they are not interested. USELESS!!!!!

 

 

Anyone else had similar problems??

I have had some luck with the installation but you might not believe what happened. I can barely believe it myself.

 

The engineer turned up about 5 minutes after I posted this thread yesterday. He was on his own. I asked if he was the special heights team. He said no and that he wasn't authorised to do the job:-x:-x

 

Ok so I took a deep breath and asked what he could do.

He then asked ME if I was prepared to go up on the roof and do the high stuff if he told me what to do!!!!!:eek::eek::eek:

 

Well after I stopped laughing I said yeah no problem and ended up fitting the new quad thingy to the dish and connecting the 2 new cables, clipping them to the roof tiles and under the lead etc, and finally fixing them to the wall.

 

The rest of the install was inside work and he did all of that no problem.

 

Anyway tried it all out this morning only to find that there was no signal from the second new feed so had to go up on the roof again to fix that. Turned out he hadn't fitted the connector properly on the end of wire.

About an hour ago we lost the input on the other cable. I will have to sort that one tomorrow.

 

Customer service???????????????

Professional??????????????

Tell me about it. The fact that hanging off roofs and chimneys is second nature to me is beside the point (yes I'm really father Christmas). For an engineer representing sky tv to even suggest it seems unbelievable. The only reason I agreed is because I knew I wouldn't get the job done until god knows when otherwise.:-x

I still can't use the bloody thing until I get the signal on the second input sorted. I wonder how long it would take for sky to send someone out???:rolleyes:

 

Anyway if anyone has similar stories please add them to this thread.

 

Also any advice on what to do next re compensation would be gratefully received.:)

Update:

Been up on roof and re connected the cables and all is working perfectly now.:)

 

Had a call from Sky.:eek: THEY ACTUALLY PHONED ME!!!!!!!!!!!!!!!:eek:

 

Anyway a very helpful young chap has sorted out a refund of the installation fee and also refunded one months subscription. I have to send my phone bill in when it becomes available and I will receive a refund of the cost of all the calls I have made concerning this install.

 

So nowhere near the amount of money it's actually cost me but better than nothing.

 

I have asked, and he agreed, that the engineer doesn't get into bother over this. I'd hate to see anyone lose their job.

My problem is identical.

 

Oooh, cant do it mate.

Ring my mate . Here is his number. He turns up at 8.30 Mon morning fixes new dish in under 30 mins and buggers off. Here is a bill for £350

 

Meanwhile sky dont want to know !

 

Someone get me some prozac, I am getting mad !:shock:

when we moved house got the installation engineer around everyones dishes out the back quite low down says ours has to be on a pole at the front of the house above the roof line cost an extra £150 had me by the knackers as he said he would leave and no tv for us as it was a new house i did ring sky but they dont care told us it was a contractor
