Dear Madam,

Our Client: Shell U.K. Oil Products Limited-v-

Amount Due: £447.02

We have been instructed on behalf of the above named client in connection with an amount owing to

them by you in the sum of £447.02, in respect of a personal guarantee signed by you regarding the

above company.

This amount is overdue for payment and unless we receive payment of the same in full within FIVE days

from the date of today's letter we have been instructed to issue proceedings against you for the

recovery of the above sum together with costs and interest for which you will be liable to pay. In

addition our client is entitled to recover costs and interest under the terms of the Late Payment of

Commercial Debts (Interest) Act 1998. The act allows costs and interest to be claimed as of right.

Interest is calculated on a daily basis running from the date each invoice became due for payment and is

calculated at the rate of 8.50 %. The interest in this matter totals £5.80 and is payable over and above

the debt figure. The costs are fixed in the sum of £70.00 and are also payable. Your cheque should

therefore include the interest and costs figures.

Please also note that our clients are entitled to the return of all the fuel cards to be cut up and returned

to this office. Our client's terms and conditions state that a card charge of £30.00 per un-returned card

will apply and therefore if all of the cards are not returned duly cut up, an invoice will be raised in

respect of the unreturned cards.

No further notification will be sent to you prior to proceedings being issued. All cheques should be sent

to this office but payable to Shell UK Oil Products.

Have you provided a personal guarantee on behalf of your company?

 

As for the interest.....they imply that it is calculated daily @8.5% however I am pretty sure it's meant to be an annual rate.

 

Ask for proof of the debt, proof of the guarantee etc and don't believe how they interpret the facts.

well digging into this it appears she went personal guarantee ref fuel cards but left the company four years ago

the company folded last year

 

now they have no credit or data protection licence

 

if they say they only handle biz debts

 

do they need a consumer credit licence

If you provide a personal guarantee, that makes it personal. The debt is on you not the business (assuming paperwork is all correct) and therefore you would expect to be treated under the same rules as a personal debtor. - that's my take.

they are after you as an individual so need all the relevant bits...ccl and data protection. as they are calling in a pg not sure the act applies...

also they have asked for the chq payable to shell...so may not have client account which might suggest their bank wont give them one as dont have licenses??
