      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Posted ages ago about sons Hp, decided as they weren't contacting him I would leave well alone . They did eventualy get round to him so I searched threads on here and started acting on advice to others. Sent sar, ppi reclaim and cca in same envelope [a mistake as just read advice not to do this as they merge the 2, and they have]. The answer to ppi was that we contact the place that was point of sale, the broker, and they gave address and tel number, this was where he got his car from. In other words nothing to do with them.:confused: The sar and cca came in one envelope with copy of hp agreement, a 'not up to date' statement, usual comp printouts, a copy of a loan agreement he took out not long after hp, no statement for that, copy of demand and needs statement for loan but not hp, no recordings of phone calls, an interesting print out of something that mentions commission payment of over 400 pounds :eek:. A letter with something about secured loan and your home may be at risk, with non secured loan account number on it.[phoned up about this and they said it must be for hp loan, when son said it had the other loan number on it bloke on phone didn't know what to say so son just said there is a lot wrong in all these papers and hung up], a copy of a default notice, [without prejudice and 14 days, usual], and mention in the notes about a termination, no idea about that and no copy of any termination notice.

Any way it seems to have set them off big time, as son has had letters from this howard cohen person[ to be polite] one for each account titled notice of pending legal action. Have read about this person and it seems he is well known for being a bit naughty [not my words].

I know there is a lot to absorb but I really need to get all this in some kind of order and know what son can dispute and what he can't, seems to me there is not a lot they have done right but have to be sure in my head to give son right advice, dont want to make things any worse for him. Contacted trading standards a while ago a couple of times but they never got back, have heard they are bogged under though.

Got the info but don't know what to do with what, any advice at this point would be really appreciated!

wow, that was quick, will get paper work out and look, I don't recall any mention of those but will check and let you know. lol, thread was a bit of a muddle wasn't it, sorry about that After reading main welcome thread I did hope they would send something about commissions in sar, ha! just hope it's something useful.:D

Hi ,Cohen are taking us to court to have a dept of £1200+ secured on our house.We are both severely disabled and I didnt realise how bad the debt had become.Tonight I'm going through paperwork my husband has ignored but I phoned other a/cs , and they are fine with the arrangements we've made with them.

I cant lose my house please ?

Best thing to do is start an entirely new thread about your problem and use photobucket to upload scanned images of your documents. if you google photobucket you will find it.

 

Also make sure you remove all personal details that could possibly identify you.

ha! read it, cant say I've noticed 'commission payments may be payed' on welcome agreement, and they certainly havn't told or got any tick boxes with son agreeing to it. Now what do I do with this, who should I tell first, cohen or welcome or both or neither, don't want to blow this :eek:

the more I look the more I find in this sar, this isn't the odd thing, its everything, lol they didn't sent the demand and needs copy for hp loan, they must have now noticed that it had 'no' ticked, good job son has original. I know I shouldn't but I still can't believe they do these things over and over. The 48 monthly payments don't add up to total, not figured out what they've done that for, won't be an honest mistake.

Put 3 insurances on second loan, if he didn't want them first time why would he want them the second, ppi, lifecare 24, personal accident plan.

hmm original amount applied for 800 actual amount taken 1,200 reason 'up-sell' :rolleyes:. So loan 1,200 insurances 986 :eek: !!!
