    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?
    • lolerz, many thanks for your reply and correcting my big mistake, oh dear start again. They sent the section 48 along with the Form NO 6A, it was sitting on top of the paperwork, sorry about that. SO they have sent me a Form No 6A and i have received the court paperwork with the claim form and defence paperwork.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I was employed for four months by a company, i was on a basic salary plus commission.

 

I was sacked apparently due to poor performance (or my face not fitting) on the 22nd September 2009 having just completed my 3 month probation with flying colours. They are refusing to pay the comission for appointments I set whilst employed and for sales 21/08/2009-21/09/2009 as the conformation of the sales happened after i left due to a verifcation process by the company that takes some 2 weeks.

 

Is this legal or right

If you had a contract with them stating plus comission then yes you are entitled to it. Did you have a contract?

hard to say without seeing your contract. but basically if the terms were that youd be paid commisions for the previous months sale a month in arrears (end of current working month) then yes they will have to pay if the sale was agreed prior to you leaving (i.e between u and the customer). but u need to check your contract and see what it says in it.

 

infact i pay my employees commision 2 month in arrears on all sales this allows 30days for customers to pay in which commisions are paid from such customer payments at the end of the 2nd month (60 days in total) this in there contracts too. and if i were to dismiss an employee, which so far never had do or if one was to leave, id still be legally required to pay them commission on sales they had made 2 months after they left or before if agreed advance to them leaving.

well to be honest its not very specific and could be interpetated as commission paid as part of the work you have done (i.e sales) or it can be implied that commissions are only paid whilst still in employment.

 

Does it mention anything else in company policy book or hand book you should have received with your contract, about how commission is paid?

Rather an ambiguos statement and unclear as to your rights, you could argue your case ------but if it is not worth going to court over is it going to be worth it?

 

Strongly worded letter putting forward your belief that you are due the money would be a good place to start, giving them a 7 day time limit to respond with their reasons why they will not pay you.

Hi all and thanks for the replies.

 

I have put an email request to the operations manager for a copy of the commission details realting to my period of employment and any changes during the period.

 

Next step will then be a strongly worded '7 day' letter.

 

The comission is worth some 400.00, i worked hard for it and i want it!
