Following a recent period of unemployment I have fallen behind with a number of bills. One of these is with Thames Water for £298, which has been passed to Moorcroft Debt Recovery.

 

I am unsure how, but they have my wife's mobile telephone number and are contacting her at least on a daily basis. However due to her suspicious nature she will not answer the phone to any number she does not recognise so she hasn't spoken to them as yet. I tracked their number back using 01614752870 - who calls me?

 

Having read through some of the other threads relating to this company (MDR) I do not wish to pay them anything. I would happily pay Thames Water the full outstanding amount now that I am back in employment.

 

What I would like to know is should I ask Moorcroft for a CCA for this account? Should I also ask them to stop contacting my wife, or ask her to call them and deny any association with the debt?

 

Finally if I ask them for a Subject Access Request and they don't provide the information where do I stand?

Utility bills are not covered by the CCA. By all means pay Thames Water. You could just ask them for a statement and if they don't send one then you could SAR them (I cannot think of any reason why they wouldn't send one).

 

Send this to Moorcroft's Complaints Department to stop them them phoning and if they ignore it, send a complaint to the OFT with a copy to Moorcroft. They usually buckle easily under pressure.

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

I now require all further correspondence from your company to be made in writing only.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
