Dear All

Hope everything is going according to plan.

I have a question. I have recently received all my statements from the bank for the past six years and have listed all the charges on a spreadsheet by date, type and amount. I am ready send away my letter asking for reimbursement, however, before I do this I need the following clarified. Do I send the list of charges with the whole amount i.e. what was actually applied to my account and ask for that back or do i work out what the charges would be if the £12 limit is applied?

I'm not sure about this and would appreciate any advice.

Thanks

GOOD LUCK TO ONE AND ALL :D

Nooooo :o:eek: Claim back what was taken from you in the first place. The bank will probably make you an offer based on the £12 limit - you don't have to accept it by the way - which in fact the OFT suggested as an absolute maximum but which the banks are seeing as generosity ;)

Hope this helps and good luck with your claim - not that you'll need it :)

You can claim back what was actually charged to your account!! ££££ Then if you get to filing a claim at court you can add on 8% interest!! Read as many threads as you have time to on this forum. I've been reading for 2 months and am still learning new helpful things every day!! Hope this helps and good luck!! :)

BOS

Claim No.3 for £589.75+8%, Decree received, Sheriffs Officers instructed to serve a charge 21/4!

Claim No.4:- claiming £1507.00, Court Papers submitted 5/4 !

Dear All

Hope everyone is getting on well and letting friends and family know the goood news.

The time scale set out in my LBA expires in two days time and I now need to get organised with regard to making a claim through the courts. I want to be exactly sure what I'm doing, I think a mistake now could blow it all!! I am claiming £2388, live in Edinburgh and would really appreciate a step by step idiots guide as to my next move. I believe we in Scotland have to go through the Sheriff Court and I also think there is a limit here too in terms of what you can claim.

Any help would be greatly received.

Thanks in anticipation and good luck to one and all :-|

Alun, go to Forums---Guidance Notes---Scottish Procedure---Sheriff Court.

My Small Claim of £720 & 8% & £39 court fees is due in Edinburgh Sheriff court on the 10th of October, but I know I will hear from BOS before this.

You can claim £750 small claims or £1,500.00 Summary claim, read more of the BOS threads on the site and you will get abetter idea of what the score is.

All the best

Scott.

Any advice I give is honest and in good faith.:)
