      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Only just seen this where the OFT has already stepped in to stop Link contacting neighbours to pass on messages. You have to wonder what new lows they will find to stoop to.....

Superb! I've just got back from delivering the letter to the court manager, they were in a meeting apparently so I left it with the guy at the desk reiterating the importance of it. I got a receipt too and got him to date, time and sign it personally.

 

Just read the OFT bits which are great. To quote them:

 

'We are pleased that Link has acted responsibly and taken positive steps to change its policies and procedures.

 

 

'If other businesses continue to engage in similar practices we will not hesitate to use our licensing and enforcement powers.'

 

Doh. Seems Link haven't quite dropped this method after all then have they? Sure they issued the message to my parents at their home but far as I'm concerned it amounts to the same thing, family or otherwise, they did have my address after all.

 

Regarding the litigation side of things I don't see why this couldn't lead to a judicial review given that:

 

A) It is certainly in the interests of the public and

B) The potential for many court decisions across the country could easily have been tainted by this strategy, both past and present. Just how many times have Link done this and how many people right now are unaware that today was their last day to respond when actually they've responded to Link in good faith? Chilling.

 

Anyone think Link will have the gall to send someone to court to face the judge if this bombshell has gone off? I'm counter claiming now anyway, the time they've wasted at £9.85 an hour already amounts to quite a lot :).

Yeah, guess I could do that. How would that be of benefit do you think given the evidence I have already? Is the judge any more likely to send them packing if he/she has to endure the excuses which they'll no doubt offer?

 

I just want their claim thrown out for good, ideally I feel it would be fair to ask for damages to match the total they were asking from me given the fact that they think it's fine to ruin my defence, plus statutory interest, my costs, not to mention the refund of interest charged after the Section 85 default in 2002 which the original creditor danced around for the best part of 10 months. I just want Link to learn a lesson for the simple reason that for every person that stands up to them there are probably hundreds that don't/can't.

 

In anideal world they'd lose their consumer credit licence - Either way I'll make sure enough pressure is put on them to make them behave themselves at the very least.

 

I guess if they have any sense at all they'll try and walk away from it before a trial date is given, really wouldn't want to be them in court...can you imagine what kind of a bad day that would be :eek:.

Great work emandcole - shows once again the benefit of recording phone calls and knowing your stuff because of the forum. I just hope the authorities take note. My fear, sadly, is that it will all once again be consigned to the 'admin error' and 'rogue employee' bins.

 

Unfortunately, BBC's Watchdog programme really has gone to the dogs since Anne Robinson came back - it's all trashy consumer stuff and 'let's have a song about that nasty Richard Branson' - pure populist trash, and an insult to anyone involved in genuine consumer protection.

 

I think debt collection issues will be well down their list of priorities unless it involves a celebrity, a three-eyed baby or a man with a beard dressed as a woman singing a pointless song.

 

Bring back Nicky Campbell!

Great stuff going on here and i only wish I knew about this forum 18 months ago!!! Link did exactly the same to me: tried it on with the unruly behaviour in telephone calls, went to a neighbour, tried to bully me into signing off rights to my property (which I promptly refused to do), misled me into returning a claims form to them directly and ultimately stung me with a default and a charging order a few months ago. The rather naive-looking Judge did not even let me protest it becoming final.

 

What's worse is that this is all over an alleged debt they no doubt bought cheaply and probably cannot produce a single legally binding document that contractly under-pinned the supposed debt - it is an mbna debt:mad:

 

Can anyone help with guidance on trying to fight this back or is it completely lost? Help, please.

Dont want to turn this into a watchdog debate but I completely agree. I never missed an episode, now it dont bother me. The programme has defo lost its spark.

This story would be ideal for a short Watchdog piece, because it's so easy to understand what's gone on. Would love to see Link given the same treatment as others like Lowell have gotten.

 

Sadly,as I've said before, the media don't seem to be interested in a story if there's even the remotest possibility that the money is owed - they appear to prefer cases of mistaken identity or chasing dead people.

 

In some respects we shouldn't be surprised - there is stigma with debt, which the middle classes tend to associate with an 'underclass' - but this recession is going to bring a whole lot of new 'middle class' people kicking and screaming into the world of the DCA. Then they'll change their tune and come flocking to CAG!

 

To undivert from the issue and hand, emandcole, I think you can still use the BBC Watchdog site to suggest a story. Guide them to this thread!

there are already many

"middle class people" who are members of CAG!

 

There is no stigma associated with (alleged) debt;

problems with the cesspit world of DCA's is not confined to

"an underclass";

intelligent consumers are fighting back.

 

Countless numbers of consumers are being affected by the 'Unfair Business Practices' employed by; get rich quick debt collection firms such as Link Financial and;

these firms are not regulated.

 

Yes, there are the OFT guidlines on debt collection but these are not Law.

 

The General British Consumer want these out of control DCA's brought to account and if the so-called enforcement bodies will not do their job, then Consumers must turn to the media...

Name and Shame Them!
